I <br />AUG 8 1979 <br />FooK 41 PAU, 251 <br />ADMINISTRATOR JENNINGS ADVISED THE BOARD THAT THE SHERIFF'S <br />DEPARTMENT RECEIVED TWO FORD TRUCKS BY COURT ORDER. THE COUNTY ROAD <br />& BRIDGE DEPARTMENT WOULD LIKE TO USE THE F -%OO TRUCK TO HAUL THE VOTING <br />MACHINES, AND THE SCHOOL BOARD WOULD LIKE TO HAVE THE F-600 TRUCK. HE <br />EXPLAINED THAT THERE IS MONEY IN THE BUDGET TO ACQUIRE THIS TRUCK. <br />ATTORNEY COLLINS SUGGESTED USING THE PROCEDURE ESTABLISHED IN <br />THE STATUTE FOR ACQUIRING THE TRUCKS FROM THE SHERIFF'S DEPARTMENT, WHICH <br />WOULD BE THAT THE SHERIFF PUBLISHES AN ADVERTISEMENT, HOLDS AN AUCTION, <br />AND SELLS THE TRUCKS TO THE HIGHEST BIDDER. ATTORNEY COLLINS STATED <br />THAT IF THAT PROCEDURE IS FOLLOWED, THEN THE HIGH BIDDER OBTAINS THE <br />TITLE CERTIFICATE. HE FELT THE SHERIFF'S DEPARTMENT OUGHT TO PUBLISH <br />AND GO TO BID, AS REQUIRED BY STATUTE. ATTORNEY COLLINS EXPLAINED THAT <br />THE STATUTE DOESN'T PROVIDE ANY SECURE REMEDY FOR THE COUNTY OBTAINING <br />TITLE. <br />DISCUSSION FOLLOWED, AND IT WAS SUGGESTED THE ATTORNEY WORK <br />OUT THE BEST PROCEDURE FOR THE COUNTY ROAD & BRIDGE DEPARTMENT TO OBTAIN <br />THE F -%OO TRUCK, AND THE SCHOOL BOARD TO GET THE F-600 TRUCK. <br />ASSISTANT PLANNER MARSH APPEARED IN REGARD TO A REQUEST FROM <br />WILLIAM L. AND MARY E. HAID FOR RELEASE OF EASEMENT IN WINTER BEACH <br />PARK SUBDIVISION. HE EXPLAINED THAT STAFF DID REVIEW THIS REQUEST AND <br />RECOMMENDS APPROVAL. MR. MARSH CONTINUED THAT THIS PROPERTY IS ZONED <br />R-1 AND THE REQUEST IS FOR RELEASE OF 5' EASEMENTS BETWEEN LOTS 17 & <br />19. HE STATED THAT THERE ARE EASEMENTS ON THE REAR LOT LINES, AND THERE <br />IS A 60' RIGHT-OF-WAY WHICH ALLOWS FOR SWALE AND DRAINAGE. <br />CHAIRMAN WODTKE ASKED FOR CLARIFICATION ON HOW MANY HOUSES <br />WOULD BE BUILT ON THE TWO LOTS, AND PLANNER REVER STATED THE OWNERS ARE <br />PLANNING TO BUILD ONEHOUSE IN THE MIDDLE OF THEIR TWO LOTS, <br />ON MOTION BY COMMISSIONER SIEBERT, SECONDED BY COMMISSIONER <br />DEESON, THE BOARD UNANIMOUSLY ADOPTED RESOLUTION N0, 79-72 APPROVING <br />RELEASE OF EASEMENTS OF THE SOUTH SIDE LOT LINE OF LOT 17 AND THE NORTH <br />SIDE LOT LINE OF LOT 19, WINTER BEACH PARK SUBDIVISION, AND AUTHORIZED <br />THE SIGNATURE OF THE CHAIRMAN; DOCUMENTS TO BE PREPARED AT THE EXPENSE <br />OF THE APPLICANT. <br />RESOLUTION AND RELEASE OF EASEMENTS WILL BE MADE A PART OF <br />THE MINUTES WHEN RECEIVED. <br />
