Mr. King recalled that during the process of purchasing the property, he had legal advice <br />from Jim Shroener, the Attorney who sits on their Board, and they later reserved the services of <br />Attorneys Bruce Barkett and Steve Henderson after they had been notified that Attorney O'Haire <br />had sent a letter. To the questions of what he did to verify his entitlement to an Alcohope sort of <br />use for the property, and whether he made any independent effort to verify that he would be able <br />to use the property, Mr. King replied that they contacted New Horizons. He acknowledged that <br />an attorney attended the closing with him; and he had not obtained affidavits from anyone <br />connected with New Horizons or with Alcohope as to what their use of the property had been <br />and what period of time it might have covered. He admitted that at the time of closing, <br />everything was not repaired and in working order. <br />Attorney O'Haire had no further questions, and Attorney Henderson said that <br />concluded their presentation. <br />ATTORNEY 0IHAIRE QUESTIONED COUNTY STAFF <br />Attorney O'Haire, before his presentation, asked Planning Director Stan Boling if he <br />had reviewed and approved the letter written by John McCoy on July 10, 2006. Director Boling <br />recalled that he was gone during the period the letter was sent, and did not think he saw it before <br />it was sent out. <br />Attorney O'Haire asked further if Director Boling had made any effort to verify, <br />investigate or do any due diligence past what the letter from Tom King requesting a letter from <br />staff set forth. Director Boling said staff investigated the zoning, the use, some of the history of <br />the property, and what the use had been on the property. He believed John McCoy had an <br />understanding that there had been some use of the property and that there had been some <br />hurricane damage to the property.
