DISCUSSION ENSUED ON A REQUEST MADE BY BENJAMIN P. CONKLIN <br />FOR RELEASE OF EXCESS FUNDS FROM THE TAX SALE OF PROPERTY BELONGING <br />TO MARTHA DEBORAH HELME. ATTORNEY COLLINS EXPLAINED THAT THIS IN- <br />VOLVES ANOTHER SITUATION WHERE PROPERTY WAS SOLD AT A TAX SALE, <br />THE BID WAS IN EXCESS OF TAXES DUE, AND THE CLERK, AFTER THE PROPER <br />NOTIFICATION AND TIME PERIOD, TURNED THE FUNDS OVER TO THE GENERAL <br />FUND. THE ONLY UNUSUAL SITUATION IS THAT THE PROPERTY OWNER APPAR- <br />ENTLY IS DECEASED, AND THE APPLICANT IS AN HEIR OF THE PROPERTY OWNER. <br />ATTORNEY COLLINS DID NOT BELIEVE THE COUNTY COULD DISTRIBUTE THE FUNDS <br />TO ANYONE OTHER THAN THE ESTATE AND STATED THAT THE BOARD SHOULD JUST <br />AUTHORIZE THE RELEASE TO THE ESTATE AND LEAVE IT UP TO THE APPLICANT <br />TO CURE THE PROBLEM. <br />ON MOTION BY COMMISSIONER SIEBERT, SECONDED BY COMMIS- <br />SIONER Loy, THE BOARD UNANIMOUSLY AUTHORIZED RELEASE OF THE EXCESS <br />FUNDS FROM TAX SALE OF PROPERTY UNDER CERTIFICATE #'85 (1.1/28/78) IN <br />THE AMOUNT OF $674.54 TO THE ESTATE OF MARTHA DEBORAH HELME UPON <br />ADEQUATE PROOF OF THE ESTATE. <br />IN FURTHER DISCUSSION, IT WAS FELT THAT POSSIBLY THE FORM <br />LETTER FROM THE CLERK TO THE PROPERTY OWNER SHOULD BE CHANGED BE- <br />CAUSE IT IS CONFUSING AND DOES NOT GIVE ENOUGH INFORMATION SINCE <br />IT SEEMS TO INDICATE YOU ONLY HAVE NINETY DAYS TO MAKE A CLAIM. <br />THIS WILL BE BROUGHT TO THE CLERKS ATTENTION. <br />ON MOTION BY COMMISSIONER Loy, SECONDED BY COMMISSIONER <br />SIEBERT, THE BOARD UNANIMOUSLY APPROVED OUT -OF -COUNTY TRAVEL FOR <br />CIVIL DEFENSE DIRECTOR LEE NUZIE TO ATTEND A SPECIAL HAZARDOUS <br />MATERIALS PROGRAM TO BE CONDUCTED AT WILDWOOD, FLORIDA, OCTOBER 24, <br />1979.. <br />THE BOARD NEXT DISCUSSED THE REQUEST MADE BY FRANKLIN <br />HAMILTON FOR RELEASE FROM A UNITY OF TITLE -AS EXPLAINED IN THE FOL- <br />LOWING MEMO FROM PLANNING & ZONING DIRECTOR REVER: <br />- 7 <br />OCT 241979 BooK 41 PAGE 753 <br />
