INDIAN RIVER COUNTY’S REQUEST FOR SPECIAL <br />EXCEPTION USE APPROVAL FOR A LIMITED PUBLIC <br />UTILITIES USE TO BE KNOWN AS ROCKRIDGE PUMPING <br />FACILITY “RESIDENCE”. (QUASI-JUDICIAL) <br />(Clerk’s Note: This item was heard following the break at 5:19 – 5:39 p.m. and <br />after Item 13.A.1.) <br /> <br />Planning Director Stan Boling presented this item to the Board by recapping his <br />memorandum of April 18, 2007. He outlined that this is a proposal for a pumping facility in a <br />residential zoning district, which constitutes limited utility use and special exception use. He <br />asked the Board to approve staff’s recommendation with conditions as outlined on page 241 of the <br />backup. <br /> <br />The Chairman opened the public hearing. There were no speakers and the Chairman <br />closed the public hearing. <br /> <br />ON MOTION by Commissioner Davis, SECONDED by <br />Commissioner O’Bryan, the Board unanimously found <br />that, in conjunction with the recommended condition: <br /> <br />(A)it is empowered under the provisions of Chapter 971 <br />to review the special exception applied for; (B) the granting <br />of the special exception approval will not adversely affect <br />the public interest; (C) the application satisfies the general <br />May 1, 2007 17 <br /> <br /> <br /> <br />
