REQUEST FOR FLOODPLAIN CUT AND FILL BALANCE WAIVER <br />ND <br />FOR LOT 7, BLOCK 13, VERO LAKE ESTATES UNIT 2 AT 8325 92 <br />AVENUE <br /> <br /> <br />ON MOTION by Commissioner Davis, <br />SECONDED by Commissioner Wheeler, the Board <br />unanimously approved Alternative No. 1, granting <br />Perugini Construction, Inc., the cut and fill waiver <br />based on the criteria of Section 930.07(2)(d)4 of the <br />Stormwater Management and Flood Protection <br />Ordinance, as recommended in the memorandum of <br />May 8, 2006. <br /> <br /> <br />7.T. SLAB REMOVAL AGREEMENT WITH DIVOSTA BUILDING <br />CORPORATION <br /> <br />Commissioner Lowther understood the concept of the request but felt we were changing <br />the rules because DiVosta wants to do a mass slab, and he had a problem with that. He believed we <br />were setting bad precedents when we go against our rules and regulations. <br /> <br />Chairman Neuberger thought it would make it easier on us. <br /> <br />Community Development Director Bob Keating agreed with the Chairman. He explained <br />the before and after process of pouring a slab as well as the benefits of approving DiVosta’s <br />request. He felt the builder has a good track record and supported their request. He also noted the <br />cash escrow of $100,000.00, which would guarantee removal and replacement of poured slab not <br />meeting the County’s requirements. <br /> <br />May 16, 2006 12 <br /> <br />
