ATTORNEY COLLINS DISCUSSED -WITH -THE BOARD A LETTER FROM <br />CONSULTING ENGINEER ,JAMES BEINDORF IN REGARD TO A REQUIREMENT IN <br />THE COUNTY'S EXISTING FRANCHISE APPLICATION THAT CONCEPTUAL APPROVAL <br />FOR THE UTILITIES BE OBTAINED FROM THE DER, ST. JOHN'S RIVER WATER <br />MANAGEMENT DISTRICT, AND TREASURE COAST PLANNING COUNCIL. MR. <br />BEINDORF STATED THAT THESE REGULATORY AGENCIES WILL NO LONGER GIVE <br />CONCEPTUAL APPROVAL, AND HE SUGGESTED THAT THESE REQUIREMENTS BE <br />AMENDED SO THAT THESE PERMITTING AGENCIES WILL BE NOTIFIED OF THE <br />CONTEMPLATED FRANCHISES, BUT CONCEPTUAL APPROVAL WILL NOT BE REQUIRED. <br />VICE CHAIRMAN LOY ASKED IF THE APPLICANT IS TO SHOW PROOF <br />OF NOTIFICATION OF THESE AGENCIES, AND ATTORNEY COLLINS FELT THE <br />PLANNING DEPARTMENT SHOULD PUT THE AGENCIES ON NOTICE SINCE THEY <br />WOULD BE MORE LIKELY TO GET A RESPONSE FROM THEM. <br />ON MOTION BY COMMISSIONER LYONS, SECONDED BY COMMISSIONER <br />DEESON, COMMISSIONER SIEBERT AND VICE CHAIRMAN Loy VOTED IN FAVOR, <br />THE BOARD AGREED TO DELETE THE REQUIREMENT IN THE COUNTY'S FRANCHISE <br />APPLICATION FOR CONCEPTUAL APPROVAL FROM THE DER, ST. .JOHN'S RIVER <br />WATER MANAGEMENT DISTRICT AND TREASURE COAST PLANNING COUNCIL AND <br />PROVIDE INSTEAD THAT IT WILL BE SUFFICIENT FOR THEM TO BE NOTIFIED <br />OF THE PROPOSED FRANCHISE. <br />ATTORNEY COLLINS INFORMED THE BOARD THAT THE LIEN ON THE <br />FIRST HAZARDOUS BUILDING THAT WAS TORN DOWN HAS BEEN PAID OFF. <br />RALPH ENG OF THE JOINT VENTURE PRESENTED THE BOARD WITH <br />A REVISED RATE STRUCTURE FOR THE PROPOSED WATER SYSTEM IMPROVEMENTS <br />FOR THE SOUTH COUNTY MUNICIPAL WATER TAXING DISTRICT, AS FOLLOWS: <br />59 <br />DEC 51979 BOOK, 421PAcE237 <br />
