CONSIDERATION OF PROPOSED AMENDMENTS PROVIDING FOR <br />TEMPORARY SUSPENSION OF COMPLIANCE WITH REGULATIONS <br />NOT DIRECTLY RELATED TO PUBLIC SAFETY: LAND <br />DEVELOPMENT REGULATIONS CHAPTER 902 [LEGISLATIVE/ <br />PROOF OF PUBLICATION OF ADVERTISEMENT FOR HEARING IS ON FILE IN THE <br />OFFICE OF THE CLERK TO THE BOARD <br />Planning Director Stan Boling updated the Board on this request noting that this is the <br />first of two Land Development Regulations (LDR) amendments, which deals with temporary <br />suspension of compliance at the time of Certificate of Occupancy. He described the Certificate <br />of Occupancy process, as well as the similarities to the Certificate of Completion process. He <br />outlined the proposed changes and the options if compliance becomes an issue. Staff <br />recommended that the Board consider and approve the proposed LDR amendments. <br />Chairman Davis thanked staff for bringing this forward and remarked that although not <br />all rules fit every corner of the County, this would give the County Administrator the opportunity <br />to sprinkle some common sense into the process. <br />Commissioner Wheeler, commenting on the 90 -day temporary suspension, wanted to see <br />"some teeth put in there" in the form of a $500.00 per day fine for punitive damages, rather than <br />going to the Code Board, if a job is not resolved in the given period. <br />Director Boling describing some of the options of "putting teeth" into this proposed <br />change, said one would be to revoke the Certificate of Occupancy, but staff was reluctant to use <br />that for varied reasons, which he explained. <br />May 19, 2009 13 <br />
