<br />The Board asked attorney Collins for his opinion and he agreed with the issues raised <br />by Attorney Brody, however, he did question whether a claim would succeed based on an equitable <br />estoppel or Bert Harris Act. He confirmed the fact that because the improvement is in the Traffic <br />Circulation Element and the Capitol Improvement Element of the Comp Plan it is necessary to initiate <br />Comp Plan amendments to revise those elements. <br /> Commissioner Macht clarified that the decision on May 17 was not to widen but to <br />study alternatives. <br />Attorney Collins said Public Works has looked at alternatives and their findings were <br />to be discussed later in the meeting under County Administrator matters. <br /> <br />NO ACTION REQUIRED OR TAKEN. <br /> <br />9.B.5. She read the mission statement of the Treasure <br />Coast Regional Planning Council that says “…promotes health, safety and general welfare and plans <br />for future development of the region that will keep it competitive and afford a high quality of life.” She <br />believes this is what everyone wants. She told the Board they do not have to stop growth to avoid <br />becoming like South Florida. They just have to implement the appropriate measures by reviewing and <br />changing the Comp Plan and the long-range traffic plan to accommodate the needs of all to make it <br />work. <br /> <br />NO ACTION REQUIRED OR TAKEN. <br /> <br />9.B.6.
