WINTER BEACH PARK SUBDIVISION PETITION WATER, 52" AVENUE <br />NORTH OF 65TH STREET, INDIAN RIVER COUNTY PROJECT NO. <br />UCP -2633, RESOLUTION IV, FINAL ASSESSMENT <br />ON MOTION by Vice Chair Bowden, SECONDED by <br />Commissioner Davis, the Board unanimously approved <br />Resolution 2007-070, certifying "as -built" costs for <br />installation of water service to Winter Beach Park <br />Subdivision (52nd Avenue North of 65th Street) in Indian <br />River County, Florida, and such other construction <br />necessitated by such project; providing for formal <br />completion date, and date for payment without penalty and <br />interest. <br />12. TOP HAT & TAILS SETTLEMENT OFFER <br />Attorney Collins reported that the Planning and Zoning Commission (P&Z) had denied <br />permitting, fearing excessive noise levels among other concerns, for Mercer Beck Enterprises for <br />the commercial kennel, Top Hat & Tails, they wanted to build. He related that Mercer Beck had <br />then appealed to the County Commissioners, who upheld Planning & Zoning's denial of the <br />application. Attorney Collins recapped Assistant County Attorney George Glenn's memorandum <br />of June 13, 2007, relative to the settlement letter offer received from Bruce Barkett, the attorney <br />representing Mercer Beck Enterprises.
