AS -BUILT RESOLUTION & ASSESSMENT ROLL FOR PAVING AND DRAINAGE <br />IMPROVEMENTS TO 1ST ROAD FROM 35THAVENUE TO 32ND AVE, IN VERO BEACH <br />HOMESITES SUBDIVISION, IRC PROJECT #0522 <br />ON MOTION BY Commissioner O'Bryan, SECONDED <br />by Commissioner Solari, the Board unanimously approved <br />Resolution 2009-074, certifying "As -Built" costs for <br />certain paving and drainage improvements to 1st Road <br />from 35th Avenue to 32nd Avenue, designated as Project <br />No. 0522, and other construction necessitated by such <br />project; providing for formal completion date, and date for <br />payment without penalty and interest. <br />12.J. UTILITIES SERVICES <br />12.J.1. SR 60 UTILITY CONFLICT RESOLUTIONS WITH FDOT DRAINAGE, PAVEMENT AND <br />TRAFFIC SIGNAL IMPROVEMENTS FROM INDIAN CREEK BLVD. TO 66TH AVENUE, <br />FINAL PAY TO EXPERTECH NETWORK INSTALLATION (US), INC. FOR CONSTRUCTION, <br />REIMBURSEMENT TO MASTELLER & MOLER FOR ADDITIONAL CONSTRUCTION <br />SERVICES AND REIMBURSEMENT TO MR. G. M. BEUTTEL FOR A CONSTRUCTION <br />STAGING AREA, UCP #3026 <br />Commissioner O'Bryan requested further information on this matter. <br />Erik Olson, Director of Utility Services, said that the three contractors involved in the <br />project had been advised of the necessity to complete the project on time in order to avoid <br />potential liquidated damages; however, Expertech, who continually lagged behind, completed <br />the project in April 2009, 164 days beyond the October 2009 deadline. Director Olson disclosed <br />that pursuant to the contract with Expertech, the County may assess the full amount of liquidated <br />18 <br />June 2, 2009 <br />
