HE CONTINUED THAT THEY REQUESTED THIS MATTER <br />BE PUT ON TODAY 1.S AGENDA BECAUSE THE PLANTING SEASON FOR OAKS RUNS <br />OUT THE END OF FEBRUARY, AND IF THEY PLANT AFTER THAT, THEY WILL <br />LOSE A GREATER AMOUNT OF THE -TREES. <br />COMMISSIONER WODTKE EXPRESSED CONCERN ABOUT MAINTENANCE <br />OF THE LANDSCAPING AFTER THE TEN YEAR PERIOD. HE NOTED THAT IN THE <br />EVENT THE PROPERTY OWNERS ASSOCIATION DECIDED TO DISSOLVE, HE DID <br />NOT WISH TO HAVE TO PLACE A LIEN ON 1,000 LOTS. <br />MR. SWENSEN INFORMED HIM THAT THE PROPERTY OWNERS ASSOCIA- <br />TION RUNS WITH THE LAND AND THE COVENANTS TIE EACH PROPERTY, NOT <br />THE OWNER, BACK TO THE ASSOCIATION. THERE IS A LIENING MECHANISM. <br />CHAIRMAN SIEBERT FELT THAT ANYTHING CAN BE REMOVED AND <br />DISSOLVED BY THE PROPERTY OWNERS ASSOCIATION, AND MR. SWENSEN <br />POINTED OUT THAT GENERAL DEVELOPMENT MAY NOT EXIST IN PERPETUITY <br />EITHER. HE BELIEVED THAT AN ASSOCIATION CONSISTING OF OVER 1,000 <br />LOTS WILL REMAIN, AND NOTED THAT THE COST FOR THIS SMALL AREA WILL <br />BE INFINITESIMAL SPREAD OUT OVER THAT MANY LOTS. MR. SETTLES FURTHER <br />NOTED THAT THEY HAVE PLANS FOR RECREATIONAL FACILITIES AND OTHER <br />AMENITIES SO THE ASSOCIATION WOULD HAVE ADDITIONAL OBLIGATIONS. <br />COMMISSIONER LYONS STATED THAT HE LIKED THE IDEA OF THE <br />TREES, BUT WISHED TO PROTECT THE COUNTY. HE ASKED IF THERE WAS ANY <br />WAY TO TIE INTO THE TERMS OF THIS AGREEMENT THAT THE PROPERTY OWNERS <br />ASSOCIATION COULDN'T SUDDENLY DECIDE ON A NEW CHARTER. <br />ATTORNEY COLLINS FELT THERE COULD BE A SEPARATE PROVISION <br />INCLUDED STATING THAT THIS PARTICULAR PROVISION COULD NOT BE AMENDED. <br />COMMISSIONER LOY ASKED WHAT KIND OF PROVISION GDC HAD IN <br />THEIR ORIGINAL DEEDS, AND MR. SWENSEN STATED THAT THEY DIDN'T HAVE <br />ANY BECAUSE THAT WAS A HOMEOWNERS ASSOCIATION AND STRICTLY VOLUNTARY, <br />THE NEW BUYERS WILL BE LEGALLY TIED INTO THE PROPERTY OWNERS ASSOCIATION. <br />HE CONTINUED.THAT THEY ARE OFFERING THE EXISTING HOMEOWNERS AN <br />OPPORTUNITY TO JOIN THE NEW ORGANIZATION AND MAKING IT ATTRACTIVE <br />FINANCIALLY. <br />BOOK, . fAicE <br />
