application, and believed that, if the proposal is approved, it will be difficult to stop it once it <br />gets going. <br />Mr. Paladin, President, Black Swann Consulting, alluded to Chapter 926, which governs <br />landscaping, stating that four years of work went into its creation and some of it has not yet been <br />used. He urged the Board to use caution when making any quick changes, and supported having <br />staff review the LDR's to ascertain what the problems are, and to make any changes slowly. <br />Further deliberations ensued as Mr. Paladin and the Commissioners considered the 90 - <br />day temporary suspension ordinance; whether to develop a permanent exception ordinance or to <br />identify the problem LDR's and develop amendments to resolve the problems; and the use of the <br />"functional equivalent" to allow business people sufficient flexibility to meet the LDR standards. <br />The Chairman CALLED THE QUESTION, and by a 4-1 <br />vote (Chairman Davis opposed), the Motion carried. The <br />Board approved staff's Recommendation No. 1 <br />(Alternative 2), to direct PSAC and staff to identify <br />"problem LDRs" and develop proposed amendments to <br />resolve the problems identified. <br />MOTION WAS MADE by Commissioner Solari, <br />SECONDED by Commissioner Wheeler, to direct staff to <br />initiate the formal LDR amendment process to develop a <br />Permanent Exception Ordinance that builds on PSAC's <br />Recommendations 1 and 2, and to return to the Board with <br />an LDR. <br />26 <br />June 23, 2009 <br />
