ON MOTION BY COMMISSIONER WODTKE, SECONDED BY COMMISSIONER <br />LAY, THE BOARD UNANIMOUSLY AUTHORIZED FINAL APPROVAL OF PINECREST <br />SUBDIVISION, PREVIOUSLY CALLED MITCHELL ESTATES SUBDIVISION, SUBJECT <br />TO A LETTER OF AGREEMENT SIGNED AND APPROVED BY ATTORNEY COLLINS AS <br />TO THE ESCROWING OF FUNDS GUARANTEEING COMPENSATION ON COMPLETION OF <br />THE DRAINAGE, WATER SYSTEM, AND BACK -FILL; AND SUBJECT TO RECEIPT OF <br />A $5,000 CASH BOND FOR THE BACK -FILLING OF THE WATER LINE TRENCHES, <br />THE GRADING, AND SEEDING OF THE SWALE DITCHES; AND ALSO ACCEPTING <br />THE $25,686 AS PER THE LETTER OF FEBRUARY 14, 1980, FROM TOTAL DEVELOP- <br />MENT; AND AUTHORIZING THE SIGNATURE OF THE CHAIRMAN AND ADMINISTRATOR AFTER <br />RECEIPT OF THE ABOVE MENTIONED ITEMS. <br />ATTORNEY COLLINS INTERJECTED THAT MONIES WOULD NOT BE <br />RELEASED FROM THE COUNTY'S ESCROW ACCOUNT UNTIL THE COUNTY HAS <br />ACCEPTED THE RIGHTS FROM THE BUILDER. <br />DISCUSSION FOLLOWED ABOUT THE WATER FACILITIES. <br />COMMISSIONER WODTKE SUGGESTED THE BOARD COULD CONSIDER, IN <br />THE ISSUING OF FRANCHISES AND FINAL APPROVAL OF PLATS, THAT THE BOARD <br />NOT APPROVE THE PLAT UNTIL THE WATER SYSTEM IS COMPLETED AND DEEDED <br />TO THE COUNTY, AS THE BUILDER MAY DEFAULT. <br />ATTORNEY COLLINS MENTIONED THAT THE COUNTY'S REMEDY WOULD <br />BE TO SUE FOR SPECIFIC PERFORMANCE TO ACQUIRE THE DEED THAT WAS <br />PROMISED BY THE BUILDER. HE CONTINUED THAT HE FELT THERE ARE. <br />SUFFICIENT ASSETS IN THE FORM OF THE BOND. <br />ADMINISTRATOR JENNINGS COMMENTED THAT HE DID NOT THINK THE <br />BONDS WERE HIGH ENOUGH, AND FELT THEY SHOULD BE INCREASED 50%; THIS <br />MIGHT BE AN INDUCEMENT FOR THE BUILDER TO FINISH HIS PROJECT AND GET <br />IT ON RECORD. <br />ADMINISTRATOR .JENNINGS THEN REQUESTED AUTHORIZATION TO <br />PROCEED WITH PAVING OF CAVALLA ROAD IN BONITA BEACH SUBDIVISION. HE <br />CONTINUED THAT MATCHING MONEY IS AVAILABLE FOR THIS PROJECT, AND <br />THE TOTAL COST TO THE PROPERTY OWNERS OF BONITA BEACH WOULD BE $12,106.50. <br />ON MOTION BY COMMISSIONER WODTKE, SECONDED BY COMMISSIONER <br />DEESON, THE BOARD UNANIMOUSLY AUTHORIZED THE ADMINISTRATOR TO <br />31 <br />FEB 2 01980 <br />
