FEB 2 01980 sooK 42 FAGt 770 <br />COMMISSIONER Loy INFORMED THE BOARD THAT THE ONLY CHANGES <br />MADE ON THE ORIGINAL OVERALL PLAN IN THE NORTHERNMOST SECTION ARE <br />WHERE THE SEWER PLANT IS LOCATED; EVERYTHING THAT SAYS SPORTS FIELD <br />HAS BEEN COMPLETELY REMOVED, AND THE RESTROOM FACILITIES HAVE BEEN <br />MOVED INTO THE CENTER OF THAT PIECE OF PROPERTY, AS HAD BEEN SPECIFI- <br />CALLY REQUESTED BY THE PEOPLE OF THE INDIAN RIVER SHORES COMMITTEE. <br />SHE CONTINUED THAT.WE HAVE MADE A VERBAL COMMITMENT TO THE ALLIANCE <br />FOR THE ARTS FOR THE USE OF TWO BUILDINGS IN THE SOUTH END OF THE <br />PARK PROPERTY, ONE FOR THE HISTORICAL SOCIETY AND ONE FOR THE ALLIANCE <br />OF THE ARTS. SHE FURTHER NOTED THAT WE WERE REQUESTED TO HAVE A 50' <br />BUFFER ZONE ON THE NORTH AND SOUTH OF THE PIECE WE BOUGHT, AND WE <br />PLAN AT LEAST A 75' BUFFER. THESE ARE THE ONLY CHANGES IN THE ORIGINAL <br />PLAN, AND COMMISSIONER LOY NOTED THAT SHE JUST WISHED THE BOARD TO <br />BE AWARE THAT WE ARE MAKING AN EFFORT TO GET BEFORE THE PROPER BOARD <br />OF THE TOWN OF INDIAN RIVER SHORES. <br />ATTORNEY COLLINS STATED THAT THE BOARD SHOULD PURSUE AN <br />OVERALL BLANKET APPROACH TO COVER ALL BASES. HE NOTED THAT THE <br />STANDARD BETWEEN GOVERNMENTAL AGENCIES IS NOT A FAIRLY DEPENDABLE <br />RULE SUCH AS THE PETITIONER FOR A REZONING HAS THE BURDEN OF MEETING <br />HERE; THE TEST IS THE COMPETING PUBLIC INTEREST. HOWEVER, IN ORDER <br />TO GET TO THE COURTS, YOU HAVE TO EXHAUST THE GOVERNMENTAL REMEDIES <br />FIRST. <br />COMMISSIONER WODTKE DISCUSSED THE ACQUISITION OF THE <br />COUNTY PROPERTY AND NOTED THAT THIS WAS DONE WITH A CERTAIN AMOUNT <br />OF CONCURRENCE, AND WE HAVE A RESOLUTION FROM THE TOWN OF INDIAN <br />RIVER SHORES STATING THAT COOPERATION WOULD BE RECEIVED PROVIDED WE <br />GO THROUGH THEIR SITE PLANS, HE NOTED THAT THIS RESOLUTION IS ON <br />RECORD AND SHOWS OUR ORIGINAL INTENT. <br />DISCUSSION FOLLOWED IN REGARD TO HAVING THE ATTORNEY <br />TAKE ANY ACTION HE DEEMS ADVISABLE. <br />ON MOTION BY COMMISSIONER Loy, SECONDED BY COMMISSIONER- <br />LYONGS, THE BOARD UNANIMOUSLY AUTHORIZED THE ATTORNEY TO RESPOND TO <br />THE INJUNCTION FILED AGAINST THE COUNTY BY THE TOWN OF INDIAN RIVER <br />SHORES AND TO TAKE SUCH OTHER ACTIONS AS ARE NECESSARY TO PROTECT <br />THE INTERESTS OF INDIAN RIVER COUNTY AS A GOVERNMENTAL PROPERTY OWNER. <br />
