CHURCH OF GOD IN CHRIST TEMPLE, LOCATED ON LOT 1, BLOCK 16, HILLCREST <br />SUBDIVISION, ARE HEREBY DECLARED TO BE HAZARDOUS AND ARE PRESENTING <br />A SAFETY AND HEALTH THREAT TO THE CITIZENS OF INDIAN RIVER COUNTY <br />AND MOVED THAT THE HAZARDOUS STRUCTURE BE DECLARED A NUISANCE AND <br />BE REMOVED AT THE DIRECTION OF THE COUNTY ADMINISTRATOR AND THE <br />APPROPRIATE LIEN FILED AGAINST THE PROPERTY IN THE EVENT THE COSTS <br />OF REMOVAL ARE NOT PAID BY THE OWNER. <br />ATTORNEY COLLINS NEXT REPORTED ON THE PROPERTY IN ITEM 5 <br />OWNED BY DR. CHARLES A. FENNER, BEING THE HIGHLANDS MOTEL AND POOL <br />ON NORTH U.S. 1. HE STATED THAT NOTICES HAVE BEEN SENT, AND THEY <br />HAVE PHOTOGRAPHS. ATTORNEY COLLINS NOTED THAT THE COUNTY PREVIOUSLY <br />WAS INVOLVED IN SOME LITIGATION WITH DR, FENNER IN 1975, AT WHICH <br />TIME HE WAS TRYING TO ADD IMPROVEMENTS TO THE PROPERTY 'WITHOUT A <br />BUILDING PERMIT. HE STATED THAT WE ENJOINED HIM FROM CONTINUING <br />WITHOUT A PERMIT AND HAD THE STRUCTURE DECLARED HAZARDOUS AND GAVE <br />HIM 90 DAYS TO EITHER FIX IT UP OR TEAR IT DOWN, AND THE COURT DID <br />ENTER AN ORDER REQUIRING THAT IT BE TORN DOWN. THE ATTORNEY CONTINUED <br />THAT WE HAVE TWO AVENUES OF APPROACH - HAZARDOUS STRUCTURES AND <br />CONTEMPT OF COURT FOR FAILURE TO TEAR THE BUILDING DOWN AS REQUIRED. <br />DR. FENNER CAME BEFORE THE BOARD AND STATED THAT HE HADN'T <br />RECEIVED ANY CORRESPONDENCE WITH RESPECT TO THIS PROBLEM, AND THEY <br />WERE IN THE PROCESS ABOUT THE 5TH OF FEBRUARY OF CLEANING UP THE <br />HURRICANE DAMAGE WHEN A REPRESENTATIVE OF THE BUILDING DEPARTMENT <br />BROUGHT TO HIS CONTRACTOR S ATTENTION THAT THERE WAS SOME CORRESPONDENCE <br />HE HAD NOT RECEIVED. <br />CHAIRMAN SIEBERT ASKED DR. FENNER IF HE WAS AWARE OF THE <br />COURT ORDER, AND DR. FENNER STATED HE DID NOT KNOW OF THIS. <br />ATTORNEY COLLINS INFORMED THE BOARD THAT DR. FENNER WAS <br />PRESENT AT THE COURT AND DID RECEIVE A NOTICE, AND DR. FENNER STATED <br />THAT IF HE WAS REFERRING TO 1975, HE WAS AWARE OF THAT. <br />CHAIRMAN SIEBERT ASKED IF HE REMEMBERED BEING GIVEN 90 DAYS <br />BY THE COURT TO REMOVE THE STRUCTURE. <br />52 <br />MAR 51980acF <br />
