AGREEMENT <br />I <br />WX 43. PnEx.24 <br />THIS AGREEMENT made and entered into this 6th <br />day of February, 1980, by and between GENERAL DEVELOPMENT <br />CORPORATION, a Delaware Corporation, authorized to do business <br />in the State of Florida, hereinafter referred to as "General" <br />and Indian River County, Florida, hereinafter referred to as <br />"Indian River County"; <br />WITNESSETH <br />WHEREAS, General applied to the Indian River County <br />Planning Commission on October 18, 1979, for rezoning and <br />site plan approval of a 3Tacre entrance feature to the Vero <br />Highlands community, located in Indian River County, Florida, <br />and particularly described as follows: <br />Tracts A and B of Vero Beach Highlands, <br />Unit One Subdivision, according to the <br />Plat thereof recorded in Plat Book 5, <br />Page 29, of the Public Records of Indian <br />River County, Florida. <br />All that part of the north 643.7 Feet of <br />the South 1083.7 Feet of the NE 1/4 in <br />Section 31, Township 33 South, Range 40 <br />East, lying West of the West right-of-way <br />of U.S. Highway No. 1, as now located, <br />and East of the East right-of-way of the <br />Florida East Coast RR, Indian River County, <br />Florida: <br />WHEREAS, included within the entrance feature site <br />approval request was a proposal by General to plant trees, <br />shrubs, and other landscaping in the median of Southwest <br />20th Place and along either side of said street in the <br />public right-of-way for a distance of approximately 1,000 <br />feet from U.S. 1, and <br />WHEREAS, Indian River County favors actions that <br />enhance and beautify the County but wishes to be assured that <br />the landscaped portion entrance feature will be continually <br />and properly maintained; <br />
