Vero Beach City Manager Jim Gabbard revealed that the Supervisor of <br />Elections was originally going to clarify some issues with the Attorney General; however, she <br />had been unable to do so. The City was now trying to determine if House Bill 7135, Chapter <br />2008-227 (relating to the creation of a separate utility authority), applies to them. He spoke of <br />the huge financial impact that might occur as a result of the Bill, and urged the Board to be <br />deliberate and cautious before taking any action. He thereafter invited the Commissioners to <br />gain some additional perspective by touring the City Utility facility and discussing with staff the <br />City's plans for the future of the facility. <br />The Board, staff, and Mr. Gabbard thereafter discussed the 10% City utility <br />tax, the County's franchise fee, and whether or not the fees charged by the City of Vero Beach <br />Electric Utility were equal for City Utility customers inside and outside the City Limits. <br />Lee Regan, 3207 Anthem Way, noted that the Utilities Commission only <br />advises the City on technical matters, and that the purpose of the proposed Referendum would be <br />to hold the City accountable. <br />Clerk's Note: For further discussion of this item, please refer to Item 12.G.1. <br />Office of Management and Budget. <br />The Chairman called a recess at 10:41 a.m. and reconvened the meeting at <br />10:55 a.m. <br />27 <br />August 12, 2008 <br />
