memorandum of August 1, 2008, Attorney DeBraal described the road project and the subject <br />property, and explained the necessity of acquiring the parcel; conveyed the appraisal value of the <br />property; and outlined the process of filing a lawsuit in eminent domain should the Flemings <br />not accept the County's offer. He thereafter presented staff's recommendation, to make an <br />unconditional offer of $15,000.00 (almost twice the appraised value), and then to file a lawsuit in <br />Eminent Domain, if the offer is rejected. <br />Assistant Public Works Director Chris Mora thereafter displayed a map of the <br />subject area and responded to questions from the Board regarding the amount of set -back which <br />would remain after the right-of-way acquisition. <br />MOTION WAS MADE by Commissioner Flescher, to <br />approve staff's recommendation. MOTION FAILED, for <br />lack of a SECOND. <br />Linda Fleming, 6880 16th Street, did not believe the road being paved was for <br />the public good. She divulged that she had only received notice of today's meeting at 7 p.m. last <br />night; had not seen the appraisal; had not received her "Letter -to -Owner," nor received a written <br />offer; and has had no negotiations regarding her property. She perceived that the quick take <br />option was not available to the County. <br />Staff members provided some explanations for the delay in noticing Mrs. <br />Fleming, but the Board felt that it was inexcusable, and that there was an inherent problem in the <br />system. <br />Apologies were proffered to Mrs. Fleming by the Board and by Administrator <br />Baird, who provided assurance that the County would sit down with Mrs. Fleming and schedule <br />some meetings. <br />60 <br />August 12, 2008 <br />
