<br /> <br /> <br />In response to Commissioner Wheeler, Director Keating anticipated the density <br />would be less than 2 units/acre. <br /> <br />The Chairman opened the public hearing and asked if anyone wished to be heard <br />regarding this matter. There were no speakers and the Chairman closed the public hearing. <br /> <br />MOTION WAS MADE by Commissioner Davis, <br />SECONDED by Vice Chairman Neuberger, to approve <br />staff’s recommendation. <br /> <br />POLICYDECISION–SWORNTESTIMONYONQUASI-JUDICIAL <br /> <br />MATTERS <br /> <br />Commissioner Bowden wanted to see a policy established for quasi-judicial <br />hearings similar to that used by the City of Vero Beach whereby speakers take an oath before they <br />testify in public hearings. <br />County Attorney Collins explained a State Statute on public meetings that has <br />provisions for quasi-judicial hearings allows the Commission to adopt procedures. When the law <br />was passed about 10 years ago, the then-sitting Commission chose not to adopt the procedure but <br />preferred the more informal procedures we had been using. They felt citizens would not feel <br />intimidated but we are still observing the requirements of law. <br />Commissioner Bowden explained her reasons for bringing this recommendation <br />forward particularly so people would be speaking the truth. <br />The other Commissioners felt the informal procedure has been working <br />satisfactorily and is within the law. One thought the City’s procedures were quite cumbersome <br />and that formalities would be intimidating to everyone. <br />August 2, 2005 15 <br /> <br />
