DISCUSSION FOLLOWED ALONG THOSE LINES AND IT WAS NOTED <br />THAT IT COULD BE MORE THAN ONE PROPERTY OWNER WOULD RECEIVE THE <br />BENEFIT OF THIS RELEASE. <br />COMMISSIONER WODTKE FELT THE BOARD HAS MADE A DETERMINATION <br />THAT THE CURVE IS NOT GOING TO BE UTILIZED IN THE ROAD; IT IS NOT <br />NEEDED, AND THE ONLY ACTION THE BOARD CAN TAKE IS TO DECIDE TO RELEASE <br />THE DEDICATION. HE ADDED THAT THE QUESTION IS GOING TO BE WHO IS <br />WILLING TO PAY THE FEE FOR THIS TO BE ACCOMPLISHED, AND OBVIOUSLY <br />IT WILL BE THE PROPERTY OWNER OF LOT 9. COMMISSIONER WODTKE REITERATED <br />THAT A ROAD IS NOT GOING TO BE PUT IN AS THE COUNTY DOES NOT HAVE A <br />USE FOR IT. <br />ON MOTION BY COMMISSIONER DEESON, SECONDED BY COMMISSIONER <br />WODTKE, THE BOARD UNANIMOUSLY CLOSED THE PUBLIC HEARING. <br />COMMISSIONER LYONS THOUGHT THAT EITHER IT IS GOING TO BE <br />WORTH $4,000 OR IT WILL BE WORTH NOTHING. <br />MOTION WAS MADE BY COMMISSIONER LYONS, SECONDED BY COMMIS- <br />SIONER WODTKE TO ADOPT RESOLUTION N0. 80-53 FOR RIGHT-OF-WAY ABANDON- <br />MENT AT 2ND STREET & 14TH AVENUE. <br />ATTORNEY COLLINS MENTIONED THAT SUBSEQUENT TO ADVERTISING <br />THE RESOLUTION, IT SHOULD NOT BE FORMALLY EXECUTED UNTIL_COMPENSATION <br />IS RECEIVED. HE SUGGESTED AUTHORIZING THE CHAIRMAN TO SIGN, SUBSEQUENT <br />TO RECEIPT OF $4,000. <br />COMMISSIONER LYONS WONDERED WHETHER THE BOARD SHOULD <br />EXCLUDE THAT PORTION OF THE DEDICATION THAT EXISTS ON LOTS I AND 8, <br />AS THIS PROPERTY NOW WILL GO UP INTO THOSE LOTS. <br />ATTORNEY COLLINS EXPLAINED THAT MR. GALEIWOULD BE ENTITLED <br />TO A TITLE TO THAT PART OF THE DEDICATION THAT ABUTS HIS PROPERTY, <br />AND THE OTHER PROPERTY OWNERS WILL BENEFIT BY THE ACTION. <br />CHAIRMAN SIEBERT NOTED THERE CAN BE NO GUARANTEE, AND <br />ATTORNEY COLLINS ADVISED THAT IT WAS TRUE. <br />MR.
