Staff has deemed the structures to be unsafe and <br />uninhabitable, according to the Property & Maintenance Code of Indian River County, and <br />recommended condemnation of said structures on the subject properties. <br />Commissioner O'Bryan questioned whether the owners were notified of the pending <br />action today. Mr. Akins affirmed that the property owners were aware, and had proof by way of a <br />signed returned receipt that certified mail was delivered to the addressees. To date, Mr. Akins had <br />not heard from any of the property owners. <br />Commissioner Davis sought confirmation that legally everything was in order for <br />staff to proceed on this issue. County Attorney William Collins assured him that all legal steps <br />have been followed as required by law. <br />ON MOTION by Commissioner Davis, SECONDED by <br />Commissioner Flescher, the Board unanimously declared <br />the subject structures unsafe and a nuisance, and ordered <br />the buildings demolished with related debris removed from <br />the property by a private vendor approved through standard <br />bid procedures, as recommended in the memorandum of <br />September 11, 2007.
