RN.2005-133–TPVPT <br />ESOLUTION O HE RESERVE OF ERO HASE WO <br />–GD,I.–DDS <br /> EN EVELOPMENT NC ECLARING EFAULT IF IDEWALKS <br />CS27,2005 <br />NOT OMPLETED BY EPTEMBER <br />In response to Chairman Lowther’s concerns, County Administrator Baird stated <br />that the developer agreed to increase the letter of credit to meet the increased costs to $32,000 <br />instead of $23,000. With increasing costs, the old amount would not have covered the cost if the <br />County had been required to complete the project. <br /> <br />MOTION WAS MADE by Commissioner Neuberger, <br />SECONDED by Commissioner Davis, to approve staff’s <br />recommendation. <br /> <br />Under discussion, Commissioner Davis expressed concern about prices outpacing <br />our security requirements, and Public Works Director Jim Davis explained that the only way we <br />could verify prices would be to bid the jobs ourselves. Director Davis also stated that the bonded <br />jobs are a nightmare for his department to monitor. <br />County Attorney Collins anticipated no problems in the future because recent <br />procedure changes should resolve that concern. <br /> <br />The Chairman CALLED THE QUESTION and the motion <br />carried unanimously. (The Board adopted Resolution No. <br />2005-133 declaring default by Gen Development, Inc. in its <br />obligation to complete required offsite sidewalk <br />improvements to the Preserve of Vero Phase Two, and <br />authorizing staff to make sight draft against First Business <br />Bank (now known as First Business Bank) Irrevocable <br />September 13, 2005 4 <br /> <br />
