12. COUNTY ATTORNEY – REQUEST FOR <br />ATTORNEY-CLIENT SESSION WITH THE BOARD OF <br />COUNTY COMMISSIONERS TO DISCUSS SETTLEMENT <br />PROPOSALS WITH RESPECT TO MGD DEVELOPMENT OF <br />FLORIDA II, LLC V. INDIAN RIVER COUNTY <br /> <br />At 11:37 a.m., during consideration of Item 10., Chairman Lowther announced it <br />was time for Item 12., and read the title of this matter. <br />County Attorney Collins read the necessary legal information into the record and <br />was advised that the court reporter is here. <br />Chairman Lowther announced the following for the record: This session shall <br />commence at the open meeting and the person chairing the meeting shall announce <br />commencement and estimated length, which we think will be about a half hour, of the <br />attorney-client session and the names of the persons attending. At conclusion of the <br />attorney-client session, the meeting shall be reopened and the person chairing the meeting shall <br />announce the termination of the session. Those attending the meeting are going to be Tom <br />Lowther, Art Neuberger, Wesley Davis, Sandra Bowden, Gary Wheeler, Joe Baird, Will Collins, <br />Bill DeBraal, Attorney John Shubin by telephone, and a certified court reporter. <br />County Attorney Collins stated that was all needed for the record in the Chambers <br />and those stated will move to the Administrator’s Conference Room. He believed it was the <br />Chairman’s intention to resume meeting in the Chambers at 1:30 p.m. <br /> <br />(Clerk’s Note: The meeting was reconvened at 1:30 p.m. Commissioner Davis was <br />not present.
