AGREEMENT
<br />This Agreement Is math: Hilo 9th day of July, 11a8U,
<br />Florida Land Company, a Florida corporation, and the Board of
<br />County Commissioners of Indian River County, a governmental :trcnc;
<br />WHEREAS, Florida Land Company is the owner of certain
<br />property in Indian River County more particularly described in
<br />,Exhibit "A" attached hereto; and
<br />WHEREAS, Florida. Land Company desires to subdivide and plat.
<br />said property described in Exhibit "A" into a residential
<br />subdivision to be known as "Bent Pine"; and
<br />WHEREAS, Florida Land Company desires to construct all
<br />improvements within said subdivision in accordance with all l,.iw:;,
<br />;;ordinances, rules and regulations of Indian River County, and
<br />further desires to provide assurance to Indian River County that
<br />said subdivision will, in fact, be so constructed; and
<br />WHEREAS, the Board of County Commissioners of Indian Rivor
<br />County, as a prerequisite to approval of the plat subdividing the
<br />property desires to have assurances that construction of
<br />improvements shown on the plat will be constructed in accordance
<br />with applicable laws, ordinances, rules and regulations;
<br />NOW, THEREFORE, in consideration of the mutual promises and
<br />,undertakings set forth herein, the parties hereto agree as
<br />follows:

<br />1. In connection with the construction of improvements on
<br />lithe property described in Exhibit "A" attached hereto, which i:;
<br />l proposed to be platted into Befit Pine Unit 3 and Unit 4, Florida
<br />;!Land Company will construct the following; improvements in accor-
<br />1�dance with applicable laws, ordinances, rules and regulations of
<br />Indian River County. The cost of said improvements, pursuant to
<br />the engineer's estimate of Beindorf and Associates, Inc., is Scot
<br />forth in Column 1, a 20% inflation factor is set forth in Column ?,
<br />'i and the total of those two figures is set forth in Column 3.
