RANSON STATED THAT THEY DID NOT WANT THIS, BUT THE PLANNER FELT <br />THAT PERHAPS SOMEDAY IN THE FUTURE, IT WOULD BE NEEDED. HE NOTED <br />THE SUBDIVISION ROADS ARE PRIVATE ROADS. <br />ATTORNEY COLLINS COMMENTED THAT BY ALLOWING THESE TO BE <br />PRIVATE ROADS, THEY ARE RESTRICTING ACCESS FOR POLICE, FIRE PROTECTION, <br />ETC. <br />MR. RANSON FELT THEY HAVE TAKEN CARE OF THAT WITH THE <br />ACCESS STREET DESIGNATED AS TRACT C, WHICH GOES INTO KELLEY ROAD. <br />HE FELT THIS PROVIDES AN ESCAPE VALVE FOR THE PEOPLE IN THE SUBDIVISION. <br />SENIOR PLANNER MARSH NOTED THAT KELLEY ROAD IS AN UNPAVED <br />ROAD UP TO THIS PARCEL. <br />CHAIRMAN SIEBERT CONTINUED TO QUESTION THE FAIRNESS OF <br />REQUIRING THIS SUBDIVISION TO PAVE THE HALF ROAD ON 39TH AVE. WHEN <br />THEY DO NOT REALLY NEED IT, AND MR. RANSON ARGUED THAT THE ORDINANCE, <br />AS HE READS IT, ONLY REQUIRES THE DEDICATION. <br />MR. MARSH STATED THAT ALL ROADS ARE REQUIRED TO BE PAVED <br />UNDER THE ORDINANCE. <br />MR. RANSON AGREED BUT STATED THESE ROADS ARE NOT IN THE <br />SUBDIVISION. <br />COMMISSIONER WODTKE FELT IT IS AN ABSOLUTE NECESSITY THAT <br />THE COUNTY GET A DEDICATION ON 39TH AVENUE AND 12TH ST. S.W. AND THAT <br />THE DEVELOPER EITHER PAVE THESE OR PUT UP THE SURETY DOLLARS BECAUSE <br />THE ROAD IS THERE AND IF THE DEVELOPER CHOOSES TO BACK THE LOTS UP <br />TO IT, HE DID NOT FEEL THAT ELIMINATES HIS RESPONSIBILITY. <br />DISCUSSION CONTINUED IN REGARD TO WHAT THE REGULATIONS SAY <br />ABOUT DEDICATING AND PAVING. <br />ADMINISTRATOR JENNINGS FELT THE REGULATIONS STATE THAT <br />ALL ROADS AND HALF STREETS HAVE TO BE PAVED; HE NOTED THAT IF 12TH ST. <br />WERE TO BE MADE PUBLIC, THE DEVELOPERS WOULD BE RUNNING INTO ANOTHER <br />PROBLEM BECAUSE THE BRIDGE IS A PRIVATE BRIDGE. <br />ATTORNEY COLLINS NOTED THAT YOU CAN KEEP THE ROADS PRIVATE <br />AND HAVE AN EASEMENT WITHIN THE DEDICATION GIVING THE RIGHT FOR THE <br />PUBLIC TO CROSS OVER AND LEAVING THE MAINTENANCE, ETC., TO THE DEVELOPER. <br />56 <br />
