Jennings, County Administrator <br />FROM: Da iG'-c�rsh, Senior Planner <br />SUBJECT: Easement Release Request <br />This request for the release of the 10' public utility easement <br />lying between Lots 9 and 10, Block 3, Roseland Gardens Subdivision <br />has been previously reviewed by this Board on June 18, 1980 at <br />which time it was brought out that this is a private subdivision <br />raising the question as to the County's right to release this ease- <br />ment. According to the County Attorney, the signed acknowledgment <br />will release the County from responsibility for protection of any <br />private property rights in relation to the easement release. <br />Based on this the Planning staff could recommend approval at this <br />time. <br />DM: j t ; <br />Recommend Approval <br />4 k s <br />. Mrs <br />Mr. and Mrs. John Tyson <br />Mr. and Mrs. Edgar Williams <br />June 27,'-1-980 <br />Indian River County has been requested to release the ease- <br />ment between Lots 9 and 10, Block 3, Roseland Gardens Subdivision, <br />according to plat filed in Plat Book 8, page 25. In examining <br />the plat, it appears that the subdivision is not fully dedicated <br />to the public, but is, in fact, a private subdivision, which <br />raises rights as to owners within the subdivision, to the ease- <br />ment. Indian River County is prepared to release their interest <br />in the easement lying between Lots 9 and 10, Block 3, but that <br />does not necessarily release all interests of the easement <br />because interests of the owners within the platted subdivision <br />may still be retained. This letter is written for the purpose <br />of putting you on notice as to the facts set forth above.
