ON MOTION by Commissioner Wheeler, <br />SECONDED by Commissioner O'Bryan, the Board: <br />(1) unanimously found that: <br />(a) It is empowered under the provisions of <br />Chapter 971 to review the special exception <br />applied for; <br />(b) The granting of the special exception will not <br />adversely affect the public interest; <br />(c) The application satisfies the general and <br />specific criteria required for special exception <br />approval; and <br />(d) The conditions stated below are adequate to <br />ensure compatibility between the special <br />exception use and surrounding land uses; <br />(2) unanimously granted special exception use <br />approval for the child care use with the following <br />conditions: <br />(i) Prior to issuance of a certificate of occupancy, <br />the applicant shall install all required buffers <br />and opaque features. <br />(ii) Prior to site plan release, the applicant shall <br />dedicate, without compensation, the 5 feet of <br />right-of-way along 9th Court S.W., to satisfy <br />the 60 -foot local road right-of-way <br />requirement. <br />(iii) Prior to site plan release, the applicant shall <br />execute and record a Unity of Title to combine <br />the two lots into a single parcel, all as <br />September 9, 2008 25 <br />
