PUBLIC WORKS <br />53RD STREET RAILROAD CROSSINGAGREEMENT <br />ON MOTION by Vice Chairman Davis, SECONDED by <br />Commissioner Flescher, the Board unanimously approved <br />Alternative 1, the License Agreement, and authorized the <br />Chairman to execute same, as recommended in the <br />memorandum of August 22, 2008. <br />AGREEMENT ON FILE IN THE OFFICE OF THE CLERK TO THE BOARD <br />12.J. UTILITIES SERVICES <br />I. APPROVAL OF CONSENT ORDER WITH THE FLORIDA DEPARTMENT <br />OF ENVIRONMENTAL PROTECTION (FDEP) AND INDIAN RIVER <br />COUNTY FOR THE SOUTH REVERSE OSMOSIS WATER TREATMENT <br />PLANT <br />Utilities Director Erik Olson informed the Board that Indian River County South <br />Water Treatment Plant currently discharges its "brine -discharge" into the South Relief Canal. <br />This discharge is permitted by the Department of Environmental Protection (DEP) and staff is <br />currently in the process of getting that re -permitted. DEP has expressed the wish for the County <br />to go through some extensive testing and monitoring to determine if indeed we could continue <br />with the process of discharging within the South Relief Canal. In order to allow us to continue <br />doing this over the next three years, subject to more possible extensions, DEP wants the County <br />to enter into a Consent Order, which is just a process of permitting, and for which staff was <br />seeking approval. <br />ON MOTION by Vice Chairman Davis, SECONDED <br />by Commissioner Flescher, the Board unanimously: (1) <br />September 9, 2008 38 <br />
