AGREEMENT ON FILE IN THE OFFICE OF THE CLERK TO THE BOARD <br />13. COUNTY ATTORNEY MATTERS <br />13.A. DIVOSTA/WATERWAY VILLAGE LITIGATION UPDATE <br />(Clerk's Note: Backup Memorandum dated January 11, 2010, regarding DiVosta <br />Settlement Expenses, was received prior to the meeting and is on file in the Office of the Clerk to <br />the Board.) <br />MOTION WAS MADE by Commissioner Wheeler, <br />SECONDED by Commissioner Davis, under discussion, <br />to approve a Budget Amendment to fund the legal <br />expenses for Shubin and Bass, P.A. <br />Attorney Collins provided an update on the DiVosta/Waterway Village Litigation, and <br />explained how he arrived at the Budget Amendment estimate of $11,000, which will close out <br />the DiVosta case as well as other outstanding cases currently handled by the Shubin and Bass <br />firm. <br />Vice Chairman Solari explained why he did not support the additional $11,000 outside <br />counsel expense, as mentioned in the Backup. <br />The Chairman CALLED THE QUESTION. The Board <br />by a 4-1 vote (Vice Chairman Solari opposed) approved a <br />Budget Amendment for approximately $11,000.00, to <br />fund the legal expenses for Shubin and Bass, P.A., as <br />recommended in the memorandum of January 11, 2010. <br />13 <br />January 12, 2010 <br />
