SEP 2 41980 BOOK 44 PACE 636 <br />DISCUSSION RE LEASE RE EXCHANGE HOME - APPROVED FOR ADVERTISING <br />WITH CHANGES <br />ATTORNEY COLLINS REVIEWED THE PROPOSED LEASE FOR THE <br />EXCHANGE YOUTH HOME SUBMITTED BY ATTORNEY CIANFRONE AND INFORMED THE <br />BOARD HE WAS LOOKING FOR AUTHORITY TO ADVERTISE EVEN THOUGH HE <br />REALIZED THE LEASE COULD NOT BE SIGNED TODAY. <br />COMMISSIONER LYONS QUESTIONED THE 99 -YEAR TERM OF THE LEASE, <br />AND ALSO ON PAGE 2, CONSTRUCTION OF IMPROVEMENTS, HE FELT IT SHOULD <br />SPECIFY THAT THE HOUSING FACILITY WILL "PROVIDE LIVING SPACE IN A <br />HOMELIKE ATMOSPHERE TO MINORS. If HE POINTED OUT THAT WE DO NOT WISH <br />TO BUILD AN INSTITUTION. COMMISSIONER LYONS THEN NOTED THAT THE LEASE <br />SAYS THE CONSTRUCTION OF SAID HOUSING FACILITY SHALL INCLUDE "A <br />SUBSTANTIAL HEAVILY WOODED, LANDSCAPED OUTDOOR AREA, IF AT ALL POSSIBLE " <br />SINCE THAT IS THE TYPE OF AREA INVOLVED, HE DID NOT FEEL THE "IF AT <br />ALL POSSIBLE It SHOULD BE IN THERE AS IT MIGHT BE AN INVITATION TO CUT <br />THE TREES DOWN�AND IF AT A LATER DATE THEY WANTED TO EXPAND, WE WOULNDIT <br />HAVE THE SAME ATMOSPHERE WE STARTED OUT WITH. <br />ATTORNEY COLLINS COMMENTED THAT THIS LEASE IS ALMOST WORD <br />FOR WORD THE SAME AS THE LEASE FOR ST. FRANCIS MANOR. THE GROUP <br />ENVISIONED GOING BACK AND OBTAINING MORTGAGE MONEY TO BUILD THE <br />STRUCTURE. THE COUNTY IS NOT SUBORDINATING ITS INTEREST IN THE LAND <br />FOR THE PURPOSE OF THE MORTGAGE MONEY, BUT IT IS WITHIN THE REALM OF <br />POSSIBILITY THAT THE BANK COULD FORECLOSE ON THE BUILDING AND THE <br />IMPROVEMENTS AND SOME OTHER TENANT COULD BE IN THERE - THAT IS THE <br />RISK. ATTORNEY COLLINS ALSO QUESTIONED THE TERM OF THE LEASE AND <br />FELT THE FINANCING WOULD NOT REQUIRE MORE THAN A SO, OR POSSIBLY 40 <br />YEAR TERM. <br />COMMISSIONER LOY NOTED THAT THE LEASE ON THE SUNSHINE CENTER <br />WAS FOR 40 YEARS, <br />ATTORNEY COLLINS FELT WE SHOULD SPECIFY A TIME PERIOD <br />WHEREIN THEY HAVE AN OPPORTUNITY TO CONSTRUCT THE PREMISES, AND IF <br />THEY DON T, WE TERMINATE, <br />HE ALSO FELT WE NEED TO BETTER DEFINE THE <br />
