OCT 2 2 1990 <br />Boax <br />the North side of 15 foot drainage easement 233.74 <br />feet to the Northwest corner of the Sunshine <br />Rehabilitation Center property; thence run South <br />245 feet; thence run East on a line parallel with <br />the North right-of-way line of 16th Street 250 <br />feet; to a point on the West right-of-way line <br />of 17th Avenue; thence run South 20 feet to the <br />Point of Beginning, containing 1.632 acres, more <br />or less. <br />45 PACE ffs <br />1. The term of this lease shall be for a period of four- <br />teen (14) years, commencing on the date of the execution of <br />same. <br />2. It is understood that the above described land shall <br />be used exclusively for public recreational purposes available <br />to the public at large. There shall be no differential in <br />charges between in -city and out -city participants. <br />3. The City will make all the necessary improvements on <br />said property in order to convert the same into a recreational <br />area and will maintain the same as a recreational area during <br />the term of this lease, at the City's expense. Any improvements <br />to the real property shall vest in the County at the termination <br />of this lease. <br />4. The City agrees not to use or permit the use of said <br />premises or any part thereof for any unlawful purpose or <br />offensive use. The City represents that the leased premises <br />shall be used as a football field and other sports activities. <br />5. This lease shall not be assigned and no part of the <br />leased premises shall be subleased nor used for any purpose <br />other than that expressed in this lease. <br />6. The County may terminate this lease at any time prior <br />to its expiration by providing the City written notice eighteen <br />(18) months in advance of its intention to do so. At the end <br />of said eighteen (18) month period, this lease shall then <br />terminate. <br />7. The City agrees to provide liability insurance naming <br />County as co-insured with minimum coverage of at least Three <br />Hundred Thousand ($300,000.00) Dollars for each individual injury <br />and Five Hundred Thousand ($500,000.00) Dollars for multiple <br />injuries and to supply County with Proof of Insurance prior to using <br />
