G. <br />Chairman O'Bryan confirmed with staff that the permit from <br />the Department of Environmental Protection (DEP) had been <br />received, and that 154,700 cubic yards of beach compatible sand <br />would be adequate to repair the storm damaged dunes. <br />ON MOTION by Commissioner Solari, SECONDED by <br />Commissioner Flescher, the Board by a 4-0 vote (Vice <br />Chairman Davis absent): (1) approved the bid award to <br />Guettler Brothers Construction, LLC in the amount of <br />$3,076,920; (2) approved the sample Agreement; and <br />(3) authorized the Chairman to execute said Agreement after <br />receipt and approval by the County Attorney of the required <br />Public Construction Bond and Certificate of Insurance by Risk <br />Management, and after the County Attorney has approved the <br />agreement as to form and legal sufficiency. <br />Utilities Services <br />None <br />13. COUNTY ATTORNEY MATTERS <br />9:35 A. Resolution denouncing interest in SeaTurtle Lane in Settlement of the <br />a.m. Lawsuit of Mitchell vs. Brady and Indian River County <br />(memorandum dated July 1, 2014) <br />53-59 <br />Deputy County Attorney William DeBraal provided background on the <br />lawsuit in the Surf Colony Subdivision, which involved a 10 -foot <br />boundary dispute and a series of agreements to adjust the beach access <br />point. He asked that the Board approve the Resolution to denounce <br />County interest in the roadway and beach access walkway. <br />ON MOTION by Commissioner Flescher, SECONDED by <br />Commissioner Solari, the Board by a 4-0 vote (Vice Chairman Davis <br />absent) approved Resolution 2014-062, formally denouncing any <br />interest it presumes to have in (1) a certain roadway platted in 1953 as <br />Tamrich Road, now known as Sea Turtle Lane, and (2) a certain 4 -foot <br />walkway, both within the Plat of Surf Colony as recorded in Plat Book <br />3, Page 37 of the public records of Indian River County Florida. <br />14.
