FLORIDA LAND COMPANY REQUESTING ATTORNEY GENERALS OPINION <br />ATTORNEY STEVE HENDERSON, REPRESENTING FLORIDA LAND COMPANY, <br />CAME BEFORE THE BOARD AND REVIEWED THE APPLICATIONS IN QUESTION. <br />HE CONTINUED THAT ON SEPTEMBER 17, 1980, FLORIDA LAND COMPANY PUT IN <br />AN APPLICATION TO THE PLANNING DEPARTMENT FOR 672 UNITS, KNOWN AS <br />RIVER BEND. ATTORNEY HENDERSON COMMENTED THAT AROUND OCTOBER 1ST, <br />THEY PUT IN A SECOND APPLICATION FOR A PROJECT KNOWN AS BEACH COLONY, <br />WHICH IS NEAR RIVER BEND, BUT SEPARATED BY ABOUT 1/4 OF A MILE. HE <br />STATED THAT AT THAT TIME, A'QUESTION AROSE IN THE PLANNING DEPARTMENT <br />WHETHER THIS WOULD BE IN THE REGION OF A DEVELOPMENT OF REGIONAL <br />IMPACT; AND THE PLANNING DEPARTMENT STATED THEY WOULD NOT PROCESS <br />THE APPLICATION WITHOUT A BINDING LETTER FROM THE STATE PLANNING AGENCY. <br />FOLLOWING THAT, THE ATTORNEY CONTINUED THAT THE DEVELOPER WITHDREW <br />THE BEACH COLONY PLAN, AND THEN ON OCTOBER 6TH, THE PLANNING DEPART- <br />MENT INFORMED THEM THAT WHETHER IT WAS ONE PROJECT OR TWO PROJECTS, <br />THEY WERE GOING TO REQUIRE A DRI BINDING LETTER AS A PREREQUISITE FOR <br />THE SITE PLAN, EVEN THOUGH THE BEACH COLONY PROJECT HAD BEEN WITHDRAWN. <br />ATTORNEY HENDERSON STATED THAT ON NOVEMBER 1OTH, THE MATTER WAS <br />SUBMITTED TO THE BOARD OF ADJUSTMENT AND THEY UPHELD THE DECISION OF <br />THE PLANNING DEPARTMENT. HE THEN PROCEEDED TO DISCUSS A FEW POSSIBILITIES <br />THAT MIGHT MAKE THIS MATTER LESS TIME CONSUMING AND EXPENSIVE FOR THE <br />DEVELOPER. ATTORNEY HENDERSON STATED THAT THE DEVELOPER ACTUALLY <br />PLANNED HIS DEVELOPMENT TO FALL UNDER THE 750 UNITS THRESHOLD, AND <br />THERE ARE 672 UNITS IN RIVER BEND. IT IS TRUE, HE ADDED, THAT THE <br />DEVELOPER IS TRYING TO AVOID THE REVIEW AND BINDING LETTER PROCESS; <br />THERE IS NOTHING WRONG WITH THAT, AS HE WANTS TO AVOID HAVING TO GET <br />BUREAUCRATIC APPROVALS. ATTORNEY HENDERSON NOTED THAT THE DEVELOPER <br />WAS READY TO SUBMIT ANY KIND OF IMPACT INFORMATION THAT MIGHT BE <br />REQUESTED OF THEM, HOWEVER, WHEN THE REGIONAL PLANNING COUNCIL GETS <br />INVOLVED, THEY MUST CONSIDER IMPACTS ON SURROUNDING COUNTIES, NOT <br />JUST IN THE SURROUNDING AREA.
