Collins, Jr., Esquire <br />744 Reachland Boulevard <br />Vero Beach, Florida 32960 <br />Deer Joe: <br />w( ST PAI. f" .. .. ., I i <br />J ,NrS r. 11. ., ., V A <br />f L A I. l i [. <br />w1 st VAIN n1At • TTuiB <br />11OS t,' f ..t, 9 <br />As I advised your secretary, Jim Clark was called back to- <br />Orlaudo early this afternoon and was unable to attend the <br />4:00 o'clock meeting. <br />We are now in a position to formalize a possible solution <br />to this deadlock which might be of some interest to the <br />County Commission. <br />Since it has become apparent that the County may be concerned <br />about the R-2 zoning and the densities allowed thereunder, <br />Florida Land would be willing to submit to an administrative re- <br />zoning of the R-2 property to R -2B allowing eight units to <br />an acre and thus capping permitted densities on the entire <br />project to 672 units (as opposed to 1020 units). <br />Concurrent with that rezoning, the County would begin proc- <br />essing of the River Bend site plan and request for conceptual <br />approval with the understanding that if the site plan and <br />conceptual -plans came up for approval prior to the rezoning <br />bein(J completed, the site plan could be approved subject to <br />the rezoning. <br />Florida Land Company would further agree that in the event an <br />application for site plan and/or conceptual approval on <br />the project known as "Beach Colony" was ever filed, Florida <br />Land Company would acknowledge that it would be in doubt as <br />to whether Beach Colony, on its own, or in conjunction with <br />River Bend, constituted a DRI and would take appropriate <br />steps to apply for a binding letter of interpretation. <br />Finally, upon confirmation that neither the Planning Director <br />nor the Planning Board would raise the DRI binding letter as <br />a prerequisite to site plan and conceptual approval, the <br />law suit filed against the County, et al, would be dismissed <br />with prejudice.
