ATTORNEY COLLINS NOTED THAT A DEDICATION MUST APPEAR ON <br />THE PLAT TO ACTUALLY COMMIT FOR A CERTAIN REQUIREMENT, BUT HE NOTED <br />THAT IF THE STRIP WERE NOT TREATED AS HAD BEEN REPRESENTED, THERE <br />ARE A NUMBER OF SITE PLAN APPROVALS INVOLVED WITH THIS PROPERTY THAT <br />HAVE TO COME BACK BEFORE THE ZONING COMMISSION AND EACH TIME OFFERS <br />A FURTHER OPPORTUNITY. <br />COMMISSIONER BIRD STATED THAT HE WAS BASICALLY OPPOSED TO <br />THE CONCEPT OF SUBDIVIDING INTO THESE VERY SMALL PARCELS, EACH OF <br />WHICH REQUIRE SITE PLAN APPROVAL, AND IN ADDITION HE WAS OPPOSED TO <br />ONLY A 15' BUFFER AND WOULD LIKE, IF WE CAN'T DO ANYTHING ELSE, TO <br />AT LEAST TRY TO INCREASE THAT BUFFER. <br />COMMISSIONER SCURLOCK COMMENTED THAT WHILE HE HAD SOME <br />PROBLEMS WITH LONG TERM DEVELOPMENT OF THIS PROPERTY, PARTICULARLY <br />AS RELATED TO SEPTIC TANKS AND WELLS, WE ARE NEVERTHELESS WORKING <br />UNDER ESTABLISHED GUIDELINES, ALL OF WHICH APPARENTLY HAVE BEEN MET. <br />HE, THEREFORE, DID NOT SEE HOW WE CAN DENY THE DEVELOPER AT THIS POINT. <br />CHAIRMAN LYONS CONCURRED THAT THIS SUBDIVISION MEETS THE <br />CRITERIA OF OUR ORDINANCES, AND HE HAS A DIFFICULTY WITH TRYING TO <br />CHANGE THE LAW WITHOUT GOING THROUGH DUE PROCESS. <br />MICHAEL FALLIS CAME BEFORE THE BOARD SPEAKING AS PRESIDENT <br />OF COLONIAL TERRACE ASSOCIATION AND THANKED THE BOARD FOR DEFERRING <br />THIS MATTER TO GIVE THEM AN OPPORTUNITY TO BE HEARD BECAUSE THEY ARE <br />VERY CONCERNED ABOUT THE IMPACT OF THIS MULTI -FAMILY DEVELOPMENT ON <br />THE SINGLE FAMILY ZONING WITH WHICH IT IS TOTALLY SURROUNDED. MR. <br />FALLIS ASKED JOHN COLLINS, A RESIDENT OF COLONIAL TERRACE, TO ADDRESS <br />THE LEGAL ASPECTS OF THE SITUATION. <br />MR. COLLINS EXPRESSED INTEREST IN THE COMMENTS PREVIOUSLY <br />MADE ABOUT THE ORDINANCES ALREADY ON THE BOOKS. HE STATED THAT THEY <br />ARE CONCERNED ABOUT HAVING ANOTHER ORANGE TERRACE, AND HE FELT IF THE <br />BOARD IS GOING TO GIVE PLAT APPROVAL, THAT THEY COULD REQUIRE THAT <br />THE RIGHT-OF-WAY LEADING FROM THIS PARTICULAR PROPERTY TO OLD DIXIE BE <br />A PAVED ROAD FROM THE ASPECT OF BOTH NOISE AND SAFETY.
