Hatala in connection with various <br />matters including the site plan -application filed on Tamara <br />Gardens. _ <br />Mr..Hatala was scheduled for final hearing before the County Zoning <br />Board on his site plan last Thursday when he -received a call at <br />4:00 p.m. and was advised that provisions -of -Section 24-42 of the <br />Indian River County Code prohibited more than four units per acre <br />on any multiple development utilizing private wells and septic tanks. <br />Up to that point, Mr. Hatala had spent a great deal of money and time <br />developing his -site plan and working with the Planning Department. <br />We feel that the provisions of that Ordinance may have been -over _ <br />reactive and hastily adopted. Moreover, the provisions themselves <br />are difficult of interpretation. <br />We would therefore appreciate being scheduled before the County <br />Commission meeting to be held on December 31, 1980 for the purpose <br />of presenting our case for an amendment to or a repeal of that <br />section of the Ordinance. As usual, I would appreciate as much <br />notice as possible as to the approximate time that the matter will <br />be scheduled on the agenda. <br />Kindest regards, <br />JONES, FOSTER & MOS <br />By <br />Steve L. genderson <br />ATTORNEY CAIRNS COMMENTED THAT APPARENTLY THE PLANNING <br />DEPARTMENT WAS NOT EVEN AWARE OF THIS ORDINANCE BECAUSE THEY HAD <br />ALLOWED THE PLAN TO GET TO THIS POINT WITHOUT ANY PREVIOUS COMMENT, <br />HE CONTINUED THAT WHAT THEY ARE ASKING TODAY IS THAT THE BOARD RE- <br />CONSIDER AND SEE IF WHAT WAS INTENDED TO BE ACCOMPLISHED BY THIS <br />W <br />
