ATTORNEY COLLINS NOTED THAT HISTORICALLY WE ALWAYS HAVE <br />TALKED IN TERMS OF S UNITS AS BEING MEDIUM DENSITY AND IF THE BOARD <br />WANTS TO MAKE AN INROAD INTO THE DENSITY THAT IS THERE PRESENTLY, <br />HE FELT THE BEST POSSIBILITY OF AVOIDING LITIGATION WOULD BE TO REZONE <br />TO 8 RATHER THAN 6. HE REALIZED THAT MR. REVER IS LOOKING AT THE <br />PLANNING ASPECT, -BUT HE I.S LOOKING TO KEEP THE COUNTY OUT OF COURT. <br />CHAIRMAN LYONS STATED THAT HE WOULD LIKE TO DO THE REZONING <br />AND HAVE IT STICK RATHER THAN HAVE AN ABORTIVE EFFORT. HE, THEREFORE, <br />WAS WILLING TO AGREE TO 8 UNITS PER ACRE, BUT FELT IT IS IMPORTANT <br />THAT WE GET ON WITH IT. <br />COMMISSIONER BIRD ASKED WHAT AREA THE CHAIRMAN WAS TALKING <br />ABOUT, AND HE STATED THE AREA NORTH OF THE TOWN OF INDIAN RIVER <br />SHORES TO THE NORTH COUNTY LINE - THE PROPERTY IN THIS AREA THAT IS <br />PRESENTLY ZONED AT 15 UNITS AN ACRE, OR R-2. <br />DISCUSSION AROSE ABOUT THE AREA DESIGNATED TOURIST - <br />COMMERCIAL WHICH HAS A DENSITY OF ABOUT 43, AND PLANNING DIRECTOR <br />REVER FELT THE PLANNING DEPARTMENT SHOULD GIVE THE BOARD AN ANALYSIS <br />AND RANGE OF POSSIBILITIES. HE NOTED THAT THE ZONING DOES NOT <br />NECESSARILY GO ALONG WITH THE COLORS INDICATED ON THE LAND USE GUIDE <br />MAP. <br />COMMISSIONER BIRD NOTED THAT THE PLANNING DEPARTMENT IS <br />SHORT OF STAFF AT PRESENT, AND PLANNING DIRECTOR REVER AGREED BUT <br />STATED HE FELT THIS IS VERY IMPORTANT AND THAT THEY CAN OVERLAY SOME <br />MAPS AND PROVIDE THE BOARD WITH SOME INFORMATION QUITE QUICKLY. <br />ATTORNEY COLLINS SUGGESTED THAT IF THE BOARD IS INCLINED TO <br />MOVE AHEAD IN THIS AREA WHICH IS ZONED 15 UNITS AN ACRE (R-2), THAT <br />THE COUNTY WRITE TO THE OWNERS OF THE PROPERTY IN QUESTION TO PUT <br />THEM ON NOTICE THAT AT THE NEXT MEETING THE PLANNER WILL BE PRESENTING <br />STATISTICS AND INFORMATION REGARDING A POSSIBLE REZONING AND THE <br />BOARD WILL CONSIDER TAKING ACTION. <br />ON MOTION BY COMMISSIONER SCURLOCK, SECONDED BY COMMISSIONER <br />FLETCHER, THE BOARD UNANIMOUSLY AGREED THAT THE CHAIRMAN SHOULD WRITE <br />THE ABOVE DESCRIBED PROPERTY OWNERS AS RECOMMENDED BY THE ATTORNEY. <br />JAN 28 1981 <br />73 <br />8009. , 45 PayE7 "J" <br />
