ORDINANCE 92- 3�9 <br />SECTION 5: Section 902.04(16) of the Administrative Mechanisms <br />chapter of the land development regulations is hereby established, <br />to read as follows: <br />"(16) Notwithstanding any section to the contrary and, as an <br />alternative to misdemeanor prosecution or other <br />enforcement procedures, an alleged violator of <br />regulations found in County Land Development Regulations <br />Chapter 927, 928, 929, or 932.06(11) may request that the <br />Board of County Commissioners, at a public meeting, <br />determine whether or not a violation of the land <br />development regulations has occurred. The alleged <br />violator may appear, with or without att-orney�, and <br />present evidence and information on the aiieqea <br />SECTION 6: Section 910.07(1)(b) of the Concurrency Management <br />System chapter of the land development regulations is hereby <br />amendedto -read-as-follows <br />"(b) Initial Development Order <br />These are development orders which constitute project approval <br />and allow for submission of building permit applications or <br />commencement of development in relation to land development <br />permits; however, initial development orders do not authorize <br />issuance of building permits for construction or changes of <br />use which require a new CO (Certi-ficate of-ocr;upancy) . Approval may be granted if the applicant has obtained an <br />initial concurrency certificate for a project or the <br />portion of a project for which initial development order <br />_approval is sought. - <br />2. Conditional approval may be granted for a site plan <br />annlira+inn if thi- annlicant has annlied for an initial <br />concurrency certificate, and concurrency reviews inaicare <br />that there is sufficient capacity to accommodate the <br />project, and the only pending requirement for issuance of <br />an initial concurrency certificate is the payment of <br />applicable traffic and utility impact fees. Approval <br />shall be subject to a condition that all applicable <br />traffic and utility impact fees associated with the <br />project approval shall be paid within 90 days of site <br />plan approval or prior to site plan release, whichever <br />occurs first.
