SECOND AMENDMENT AND EXTENSION TO <br />WETLANDS MAINTENANCE SERVICES AGREEMENT <br />This SECOND AMENDMENT AND EXTENSION TO WETLANDS MAINTENANCE <br />SERVICES AGREEMENT ("Second Amendment") is entered into as of this. Iy of December, k" -e <br />2008 ("Effective Date"), by and between INDIAN RIVER COUNTY, a political subdivision of the <br />State of Florida ("County") and ECOTECH CONSULTANTS, INC. ("Consultant"). <br />BACKGROUND RECITALS <br />A. Effective May 1, 2005, the County and the Consultant entered into the WETLANDS <br />MAINTENANCE SERVICES AGREEMENT for the provision of wetlands maintenance services as <br />set forth therein, as amended effective February 19, 2008 ("First Amendment") to add additional <br />services and to extend the term for the first of three (3) allowable renewals of one (1) year each (as <br />so amended, herein referenced as the "Agreement"). <br />B. Pursuant to paragraph 3 of the Agreement, the County may request that the Consultant perform <br />additional services under the Agreement. <br />C. Further, the County and the Consultant desire to extend the term of the Agreement as set forth in <br />paragraph 6.1 for the second of the three (3) allowable renewals of one (1) year each. <br />NOW THEREFORE, for good and valuable consideration, the receipt and sufficiency of <br />which is hereby acknowledged, the parties agree as follows: <br />1. The background recitals are true and correct, and form a material part of this Agreement. <br />2. From and after the Effective Date of this Second Amendment, paragraph 3 of the Agreement is <br />amended to include the Services as more specifically set forth in Exhibit 1, for the price set forth in <br />Exhibit 1. <br />3. From and after the Effective Date of this Second Amendment, the term of this Agreement is <br />extended though April 30, 2010. <br />4.
