JUN 31981 <br />MEMO <br />TO: Board of County Commissioners <br />�5� <br />FROM: Jeff Barton, Finance Director <br />SUBJECT: Refund of Mining Deposit- Hobart Brothers <br />DATE: May 27, 1981 <br />BOOK <br />8 PnE 576 <br />On 5/17/76, Hobart Brothers made a mining permit deposit to the county's <br />general escrow account -in the amount of $8,000.00. They have asked <br />that the cash bond be returned plus interest. There is no aggrement <br />as to the interest and I need authorization form the Board. If interest <br />were to be—paid at the passbook rate of 5', for the 5 years and 2 weeks <br />the interest would amount to $2,015.38. <br />Attached are the letters from zoning and copies of the request for re- <br />fund from Hobart. <br />FINANCE DIRECTOR BARTON ADVISED THAT THERE WAS NO WRITTEN <br />CONTRACT, THEREFORE, HE HAD NO AUTHORITY TO PAY THE INTEREST. <br />DISCUSSION FOLLOWED. <br />ATTORNEY COLLINS COMMENTED THAT THIS MATTER TOOK PLACE <br />BEFORE THE EXISTING MINING ORDINANCE CAME INTO EFFECT. HE THEN <br />INQUIRED IF THE COUNTY MADE VERIFICATION THAT THE RECLAMATION WAS <br />COMPLETE, WHICH WAS THE PURPOSE OF THE BOND. <br />MOTION WAS MADE BY COMMISSIONER SCURLOCK, SECONDED BY COM- <br />MISSIONER FLETCHER, TO TABLE THE MATTER OF REFUNDING THE MINING <br />DEPOSIT UNTIL VERIFICATION OF THE RECLAMATION HAS BEEN MADE, AND TO <br />PLACE IT ON THE AGENDA FOR THE NEXT MEETING. <br />ADMINISTRATOR NELSON SUGGESTED THAT THE COUNTY CHARGE AN <br />INSPECTION FEE. <br />ATTORNEY COLLINS NOTED THAT AFTER A MINING ORDINANCE IS <br />ADOPTED, A RESOLUTION COULD BE PREPARED TO ESTABLISH RATES AND <br />POLICIES FOR MINING. <br />THE CHAIRMAN CALLED FOR THE QUESTION. IT WAS VOTED ON AND <br />CARRIED UNANIMOUSLY. <br />FINANCE DIRECTOR BARTON DISCUSSED WITH THE BOARD THE <br />FOLLOWING SCHEDULE OF BUDGET HEARINGS: <br />
