Nelson, <br />County Administrator <br />DESCRIPTION AND CONDITIONS <br />SUBJECT: Right-of-way Acquisition by Florida D.O.T <br />Storm Grove Road.from West of Lateral "A" <br />(505) to East of U.S: I. <br />D.O.T. Budget Item #425532 <br />Project No. 88508-2601 <br />REFERENCES: Letter: C.C. Barrett, Jr., Florida <br />D.O.T. to. Neil Nelson -dated May 4,19, <br />Prior to the Secondary Road System being transferred to the County <br />jurisdiction, the Florida D.O.T. initiated the right-of-way acquisition for <br />the subject project. The County, upon receipt of the Secondary System, <br />was given the construction drawings as prepared by the D.O.T. to administer <br />the actual construction. The State D.O.T. is in the Final Judgement stage <br />of Right-of-way acquisition. They have spent $120,980. from the Transport- <br />ation -Trust Fund to date on the County's behalf. At this time, the D.O.T. <br />is requesting that the County sign the attached agreement authorizing <br />$2000. be spent from the County's Secondary Trust Fund for the completion <br />of Storm Grove Road right-of-way acquisition. <br />ANALYSIS AND ALTERNATIVES <br />As the acquisition of this right-of-way is over 98% complete and <br />construction drawings are on file with the County, the signing of this <br />agreement would "wrap up" the loose ends of.right-of-way acquisition. <br />RECOMMENDATIONS AND FUNDING <br />It is recommended that the attached Joint Project Agreement between <br />the Florida D.O.T. and Indian River County by which the County agrees to <br />remit to the D.O.T. not more than $2000. from the Transportation Trust <br />Fund for completion of right-of-way acquisition be approved. <br />ADMINISTRATOR NELSON COMMENTED THAT WE THOUGHT WE HAD ALL OF THIS <br />CLEANED UP, BUT THE D.O.T. HAS COME BACK WITH ANOTHER $1,1OO BILL. <br />RALPH EVANS, OUR RIGHT-OF-WAY LAWYER, WAS CONTACTED, AND,HE HAS <br />RECOMMENDED THAT WE GO AHEAD WITH THE $2,000 AGREEMENT REQUESTED BY <br />THE D.O.T. <br />ON MOTION BY COMMISSIONER SCURLOCK, SECONDED BY COMMISSIONER <br />WODTKE, THE BOARD UNANIMOUSLY ADOPTED RESOLUTION 81-39 AUTHORIZING THE <br />CHAIRMAN TO SIGN THE JOINT PROJECT AGREEMENT WITH THE D.O.T. RE STORM <br />GROVE ROAD IN AN AMOUNT NOT TO EXCEED $2,000. <br />
