ARTICLE 5 - BONDS AND INSURANCE <br />SC 5.01A Add the following sentence immediately after the existing text in paragraph 5.01A of the <br />General Conditions: <br />Pursuant to Florida Statutes section 255.05(1)(a) (2007), any claimant (as such term is defined in <br />Florida Statutes section 713.01) may apply to Indian River County as Owner for copies of the <br />Agreement and the recorded payment and performance bonds and shall thereupon be fumished <br />with certified copies of such documents. <br />SC 5.03B Delete existing paragraph 5.03B of the General Conditions in its entirety. <br />SC 5.04B Delete existing paragraph 5.04B of the General Conditions in its entirety and replace with <br />the following: <br />B. The Contractor shall not commence Work under the <br />required under the Agreement and the Indian River Countn y mRisk Managert until it has ohasna all ved such <br />ch <br />insurance. The Contractor shall procure and maintain, for the duration of the Agreement, the <br />minimum insurance coverage as set forth herein. The cost of such insurance shall be included in the <br />Contract Price <br />C. The insurance required by paragraph 5.04A of the General Conditions shall provide coverage for <br />not Tess than the following amounts or greater where required by Laws and Regulations: <br />1. Workers' Compensation: To meet statutory limits in compliance with the Workers <br />Compensation Law of Florida. This policy must include employers' liability with a limit <br />$500,000 for each accident, $500,000 disease policy limit and $100,000 disease each <br />employee. Such policy shall include a waiver of subrogation as against Owner on account of <br />injury sustained by an employee(s) of the Contractor. <br />2. Commercial General Liability: A per occurrence form policy, including Premise Operations, <br />Independent Contractors, Products and Completed Operations including X, C, U (Explosion, <br />Collapse, Underground) Broad Form Property Damage, Broad Form Property Damage <br />Endorsement, with a combined single limit of not less than $3,000,000 general aggregate to <br />include products/completed operations, personal injury/advertising liability, fire damage <br />/legal liability, and medical payments. Limits can be layered with an Excess Liability Policy <br />(Umbrella). <br />3. Business Auto Liability: Coverage shall indude Owned vehicles and Hired/Non-Owned <br />vehicles, for a combined single limit (bodily injury and property damage) of not Tess than <br />$3,000,000/combined single limit (Bodily Injury/Property Damage); personal injury protection <br />— statutory limits; $1,000,000 uninsured/underinsured motorist; $1,000,000/hired/non-owned <br />auto liability. Limits can be layered with Excess Liability Policy (Umbrella). <br />D. Insurance Requirements — Ten (10) days prior to the commencement of any Work under the <br />Contract, a certificate of insurance shall be provided to the Indian River County Risk Manager for <br />review and approval. The certificate shall provide that: (a) Indian River County (as Owner) and <br />Masteller & Moler, Inc. (as Engineer) be named as an additional insured on the commercial general <br />liability, auto liability, and Contractor's Builders' Risk "All Risk" insurance policies; (b) the <br />Contractor's insurance coverage shall be primary; and (c) Indian River County (as Owner) and <br />Masteller & Moler, Inc. will be given thirty (30) days' notice prior to cancellation or modification of any <br />required insurance and such notice shall be in writing by registered mail, return receipt requested <br />00800-6 <br />H1Projec t 7411Bidding Contract Specificationsl,Spec Template12OO7100800 supplementary Conditions.doc <br />
