G. The lands upon which the work is to be performed. right-of-way and easements for <br />access thereto and other lands designed for use by the Contractor in performing the <br />work are identified in the Contract Documents, All additional lands and access <br />thereto required for temporary construction facilities or storage of materials and <br />equipment are to be provided by and paid for by the Contractor. Easements for <br />permanent structures or permanent changes in existing structures are to be <br />obtained and paid for by the Owner unless otherwise provided in the Contract <br />Documents. <br />M The submission of a Bid will constitute an incontrovertible representation by Bidder <br />that Bidder has complied with every requirement of this the Instruction to Bidder, <br />that without exception the Bid is premised upon performing and furnishing the work <br />required by the Contract Documents and such means, methods. techniques. <br />sequences or procedures of construction as may be indicated in or required by the <br />Contract Documents, and that the Contract Documents are sufficient in scope and <br />detail to indicate and convey understanding f all terms and conditions for <br />performance and furnishing of the work. <br />1.05 INTERPRETATIONS AND ADDENDA <br />A. All questions about the meanings or intent of the Contract Documents are to <br />be directed in writing to the Purchasing [department. Interpretation or <br />clarifications considered necessary by Owner in response to such questions will be <br />issued by Addenda mailed or delivered to all parties recorded by Engineer as <br />having received the Bidding Documents. Questions received less than ten (10) <br />days prior to the date for the opening of Bids may not be answered. Only questions <br />answered by formal written Addenda will be binding. Oral and other interpretations <br />or clarifications will not be binding and will be without legal effect. <br />B. Addenda may also be issued to modify the Bidding Documents as deemed <br />advisable by Owner or Engineer. Only the interpretation or correction issued by <br />Owner or Engineer by Addendum shall be binding. Prospective Bidders are <br />advised that no other source is authorized to give information concerning the <br />documents or to explain or interpret the documents. <br />C. All Bidders will acknowledge in the space provided for in Section 00300 BID FORM, <br />the receipt of all Addenda and will confirm that the Addenda have been considered <br />in the preparations of their proposal <br />1.05 BID SECURITY <br />A. Each Bid must be accompanied by Bid security made payable to Owner in an <br />amount of five percent of the Bidder's maximum base bid price and in the form of a <br />certified or cashiers check or an AIA Document A310 Bid Bond issued by a surety <br />meeting the requirements of Paragraph 5 01 of the: General Conditions. <br />B. The Bid security of the Successful Ridder will be retained until such Biclder has <br />executed the Agreement and furnished the required Contract security, whereupon <br />the Bid security will be returned.
