NOLTE NOTED THAT THE LAND IS NEEDED FOR <br />BUFFER, FOR PASTURE, AND FOR EXPANSION, SHE FURTHER INFORMED THE BOARD <br />THAT THEY PROBABLY WOULD NEED ALL FIVE ACRES BECAUSE THEY CAN BUILD <br />ONLY ON THE FIRST 75'. <br />ADMINISTRATOR NELSON CONFIRMED THAT VERY LITTLE OF THIS <br />PROPERTY IS USABLE FOR STRUCTURAL PURPOSES, AND EVEN USING ONLY THE <br />FIRST 75', THEY VERY LIKELY WILL HAVE TO PUT DOWN PILINGS; THEY ALSO <br />NEED THE ACREAGE FOR RUNS BEHIND THE BUILDING, ETC. <br />CONSIDERABLE DISCUSSION ENSUED AS TO FUTURE POSSIBILITIES <br />IN THE EVENT THE COUNTY HAD TO TAKE OVER THE ANIMAL CONTROL FUNCTION <br />AND THE FACT THAT IT WOULD COST THE COUNTY CONSIDERABLY MORE THAN <br />PAYING THE HUMANE SOCIETY TO PERFORM THIS SERVICE. THE FACT THAT THE <br />STRUCTURES WOULD.REVERT TO THE COUNTY AT TERMINATION OF THE LEASE OR <br />FOR FAILURE TO PERFORM WAS BROUGHT UP, AND MRS, NOLTE FELT THERE <br />SHOULD BE SERIOUS CONSIDERATION GIVEN TO SOME KIND OF BUY—BACK CLAUSE <br />PRIOR TO THE 40 YEARS BECAUSE THE HUMANE SOCIETY WOULD HAVE TO FORFEIT <br />THEIR VERY CONSIDERABLE INVESTMENT IF THE LEASE WERE TERMINATED. <br />THE PROPOSED LEASE WAS REVIEWED IN DETAIL AND THE FOLLOWING <br />CHANGES WERE DISCUSSED AND AGREED UPON; <br />PARAGRAPH 1 — WHERE IT SAYS THAT THE SHELTER SHALL BE "FOR THE USE AND <br />BENEFIT OF THE PUBLIC WHO DESIRE TO USE THE SAME..," DELETE THE <br />PHRASE "WHO DESIRE TO USE THE SAME." <br />PARAGRAPH 2 — MRS. NOLTE WISHED TO STRIKE OUT THE WORD "OFFENSIVE" <br />IN THE PHRASE "FOR ANY UNLAWFUL PURPOSE OR OFFENSIVE USE" BECAUSE <br />OF THE POSSIBLE BROAD INTERPRETATION OF THE WORD. THE -BOARD AGREED <br />TO THIS CHANGE AND ALSO TO STRIKE OUT THE WORDS "AND USE of IN <br />THE PHRASE "FOR THE BENEFIT AND USE OF ALL THE CITIZENS..." <br />PARAGRAPH 3 - MRS. NOLTE NOTED THAT THIS PARAGRAPH PROHIBITS ANY ASSIGN— <br />MENT OR SUBLETTING OF THE LEASED PREMISES, BUT THEY HAVE BEEN TALKING <br />WITH THE AUDUBON SOCIETY AND COULD EASILY ADD A SMALL AREA FOR THEIR <br />PURPOSES. IT WAS DECIDED TO ADD THE FOLLOWING PHRASE AT THE END OF <br />PARAGRAPH 3: "WITHOUT THE EXPRESS CONSENT OF THE COUNTY COMMISSION." <br />
