4 <br />ATTORNEY COLLINS TOOK ISSUE WITH ATTORNEY GRAHAM'S <br />PRESENTATION THAT CERTAIN COUNTY EMPLOYEES HAVE NOT COOPERATED WITH <br />DR. FENNER. HE ADDED THAT THE PROBLEM IS THAT THERE ARE CERTAIN <br />LAWS WHICH HAVE NOT BEEN FOLLOWED, AND THE ENFORCEMENT OF THOSE <br />LAWS MAY SEEM AS THOUGH PEOPLE WERE NOT BEING COOPERATIVE. THE <br />ATTORNEY STATED THAT HE WAS GLAD TO SEE ATTORNEY GRAHAM INVOLVED IN <br />THIS MATTER AS HE MAY BE ABLE TO FORMULATE A PLAN, HE STATED THAT <br />IT SEEMED TO HIM IF THERE IS A SET PERIOD OF TIME, IT WOULD BE <br />REASONABLE FOR THE BOARD TO GIVE DR. FENNER THE OPPORTUNITY TO PURSUE <br />THIS AVENUE OF FUNDING. <br />COMMISSIONER SCURLOCK INQUIRED IF THE HURRICANE DAMAGE <br />QUALIFIED DR. FENNER FOR THE SBA LOAN, AND ATTORNEY GRAHAM RESPONDED <br />AFFIRMATIVELY, AND ADDED THAT IT WAS A DISASTER LOAN. <br />CHAIRMAN LYONS REPORTED THAT THE COUNTY HAS HAD THE BUILDING <br />DEPARTMENT AND AN ARCHITECT LOOK AT THE MOTEL, AND DR. FENNER SHOULD <br />UNDERSTAND THAT HE MAY STILL HAVE TO RAZE THE BUILDING. <br />SOME DISCUSSION FOLLOWED. <br />COMMISSIONER BIRD INQUIRED IF A CONDEMNATION ORDER WAS FILED <br />PRIOR TO THE 1979 HURRICANE. <br />ATTORNEY COLLINS RESPONDED THAT THIS HAS BEEN A LONG PROCESS <br />SINCE 1975 AND THOUGHT IT WAS FAIR TO SAY THAT THOSE CONDEMNATION <br />ACTIONS DID OCCUR PRIOR TO THE HURRICANE, NOT IN THE WAY OF THE CIRCUIT <br />COURT DECISION, BUT BY THE BOARD. <br />JAMES FISH, OF THE BUILDING DEPARTMENT, INFORMED THE BOARD <br />THAT HE HAD NOT BEEN FULLY INFORMED OF ALL THE DETAILS OF THE <br />CONDEMNATION, BUT HE KNEW THAT IT STARTED PRIOR TO HURRICANE DAVID. <br />COMMISSIONER SCURLOCK AFFIRMED THAT REGARDLESS OF WHETHER <br />SBA WILL GRANT A LOAN OR NOT, THIS STRUCTURE WILL HAVE TO BE DEMOLISHED - <br />ALL THE BOARD IS SAYING IS THAT THEY WILL WITHHOLD PROCEEDINGS UNTIL <br />THE SBA GRANTS OR DOES NOT GRANT THE LOAN. <br />COMMISSIONER BIRD UNDERSTOOD THAT WHEN YOU OBTAIN SBA FUNDS, <br />YOU HAVE TO HAVE SPECIFIC PLANS ON HOW THOSE FUNDS ARE TO BE USED; <br />13 <br />BOOK 4 6 Pi IN 745 <br />
