JUL 1 199' <br />The agreement provides water and sewer treatment capacity of 100,000 <br />gallons more than Vista's expected demand. This treatment capability <br />can be used by the County for projects outside of Vista properties; <br />for example, water for the proposed school at Oslo Road and sewage <br />treatment for Treasure Coast Utilities. This system represents <br />over 2,200 units, plus 40 commercial acres at build -out. When that <br />occurs, the County customer base will be virtually double the <br />present quantity. The agreement will be a culmination of Vista's <br />oblieation as stated in their original "franchise agreement". <br />RECOMMENDATIONS ,-IND FUND I I\G <br />The Administration recommends the Board of County Commissioners <br />approve the proposed agreement and authorize the Chairman's <br />signature. This agreement and the subsequent system transfer will <br />not require funding by the County. - <br />ATTORNEY COLLINS COMMENTED THAT THE PROPOSED AGREEMENT <br />INVOLVES TWO PARTS. ONE PART STATES THAT EFFECTIVELY ON THE SIGNING <br />OF THE AGREEMENT, THE PARTIES WILL CONVEY THE VARIOUS ASSETS BUT <br />THAT VISTA ROYALE MANAGEMENT WILL CONTINUE TO OPERATE THE SYSTEM <br />UNTIL FEBRUARY 1, 1982. THE ATTORNEY COMMENTED THE REASONS WERE THAT <br />THE COUNTY DOES NOT HAVE THE PERSONNEL, IT GIVES THE COUNTY AN <br />OPPORTUNITY TO GRADUALLY WORK INTO TAKING OVER THE SYSTEM, AND IT FITS <br />IN HARMONY WITH THE CONSTRUCTION OF THE FACILITIES OF THE VISTA <br />GARDENS PROJECT. ATTORNEY COLLINS REPORTED THAT ONCE WE TAKE OVER <br />THE SYSTEM, THE COUNTY WILL SERVICE THE VISTA ROYALE PROJECT AND THE <br />VISTA GARDENS PROJECT IN THE MANNER THEY ARE PRESENTLY RECEIVING. <br />HE ADDED THAT THE DER REGULATIONS MAY CHANGE TO ALLOW DEVELOPMENT <br />OF THE IMPOUNDMENT AREAS, IF THE PERMITS WERE OBTAINED. HE STATED <br />THAT THE DER WAS SELECTED IN ORDER TO ESTABLISH AN IMPARTIAL PARTY - <br />IT WILL BE LEFT TO THE PERMITTING REQUIREMENTS OF THE DER. <br />LENGTHY DISCUSSION FOLLOWED - THE BOARD EXPRESSED CONCERN <br />THAT ADEQUATE CAPACITIES FOR THIS AREA WOULD BE THE NUMBER ONE <br />PRIORITY. <br />BOB GASKILL, REPRESENTING VISTA PROPERTIES, CAME BEFORE <br />THE BOARD. HE MENTIONED THAT THE PROPERTY OWNERS THERE ARE AWARE OF <br />THE SUBSEQUENT SYSTEM TRANSFER. MR. GASKILL THEN DISCUSSED ITEMS <br />OF CONCERN IN THE TRANSFER,, SUCH AS THE RATE STRUCTURE IN THE SEWER <br />AND WATER RATES, AND THE REVERSIONARY CLAUSE. <br />4P- <br />
