Recautse <br /> neither the County nor Immanuel have original records of the impact fee payment we must rely <br /> on Pastor Roll's recollection as to the impact Ices actually paid. its it turns out pastor Roll's <br /> recollection was consistent (within a few hundred dollars) of prepayment of all County impact <br /> fees as they would have been calculated in 1990 including water, sewer, fire line. There is no <br /> evidence either documentary or testimonial, of payment of the monthly "service availability fee,' <br /> or "base facility charge" as it is now known. Immanuel Church therefore concedes that such Ices <br /> will hacc to be paid in accordance with this negotiated agreement to update Inmianucl's <br /> cntiticnncnt to connect. <br /> Actual availability was established during 2004 as evidenced by the attached as-built of <br /> imprmelnents along 58'x' Avenue.
