�soon � <br />AUG 51991 7 PnE: % <br />accomplished by an Amended -Easement Deed solely executed and <br />recorded by VISTA; however, the COUNTY will also execute such <br />documents as may be reasonably requested to show its consent to <br />any such amendment. The purpose of the right to reduce the <br />size of any such parcels of land is to reserve possible other <br />future uses of these parcels or portions thereof by VISTA, <br />subject to the following limitation: The Department of <br />Environmental Regulation or its successors in interest shall <br />determine what land area is necessary for effluent discharge at <br />full treatment capacity for both the Vista Royale and Vista <br />Royale Gardens sewage treatment facilities. If no governmental <br />agency has jurisdiction regarding the necessary land area for <br />effluent.discharge at full treatment capacity, then the parties <br />will mutually agree to the necessary land area for discharge of <br />effluent at full treatment capacity, based upon standard <br />engineering practices. <br />S. Moreover, the parties agree that the COUNTY <br />will utilize the parcels of land designated as effluent <br />discharge areas for the sole purpose of effluent discharge and <br />related activities. <br />T. In the event that any of the property <br />subject to this Agreement whether conveyed herein, or agreed to <br />be conveyed, or encumbered by any form of an easement, is not <br />used by the COUNTY or its governmental successors and assigns, <br />the parties hereto specifically agree that any part or portion <br />of the subject property not so used will revert after sixty <br />(60) days written notice to the COUNTY by VISTA, its successors <br />and assigns. This reversionary interest shall apply to all <br />property, real, personal, tangible or intangible, which is the <br />subject of this Agreement, with the exception of the Vista <br />Royale Water Treatment Plant. The County reserves the right to <br />deactivate the Vista Royale Water Treatment Plant in the event <br />that a more economical or efficient source of water supply is <br />available. Such deactivation shall not cause the property to <br />revert to Vista. <br />11 <br />
