ti <br />THE PLANNING DEPARTMENT IS SAYING THAT THE DEVELOPER SHOULD ESCROW <br />HALF THE COST FOR THE CONSTRUCTION OF PECAN ROAD. MR. MUSICK ESTIMATED, <br />BASED ON A FIGURE OF $100,000 FOR CONSTRUCTION OF A MILE OF ROAD, THAT <br />HIS CLIENT WOULD HAVE TO PUT UP AN ADDITIONAL $12,500 FOR PAVING HIS <br />HALF OF 1/4 MILE OF ROAD. THIS TOTALS UP TO A $22,500 COST TO THE <br />DEVELOPER, AND MR, MUSICK FELT THERE IS AN INEQUITY OCCURRING, HIS <br />CLIENT IS REQUESTING THAT THE BOARD ACCEPT THE 30' DEDICATION BUT NOT <br />REQUIRE HIM TO ALSO PUT UP THE ADDITIONAL $12,500 FOR CONSTRUCTION OF <br />THE HALF ROAD. <br />DISCUSSION FOLLOWED AS TO THE FACT THAT SOONER OR LATER <br />SOMEONE HAS TO PAY FOR PAVING OF THIS ROAD AND THE PHILOSOPHY IS THAT <br />THOSE WHO BENEFIT MOST FROM THE RIGHT-OF-WAY SHOULD PAY FOR THE PAVING, <br />MR. MUSICK POINTED OUT THAT IT IS WELL KNOW THAT YOU CANNOT <br />APPROPRIATE PRIVATE PROPERTY FOR PUBLIC USE WITHOUT PAYING FOR IT, <br />AND THE OWNER COULD HAVE REQUESTED APPROVAL OF THE PLAT WITHOUT OFFERING <br />TO DEDICATE ANYTHING TO THE COUNTY FOR THAT ROAD. HE FURTHER NOTED <br />THAT THE PLANNING DEPARTMENT HAS, IN EFFECT, MADE KINGS HIGHWAY A <br />LIMITED ACCESS HIGHWAY IN REGARD TO THIS PARTICULAR SUBDIVISION SINCE <br />THE LOTS ABUT THE RIGHT-OF-WAY BUT NOT ONE OF THEM ARE ALLOWED ACCESS. <br />ENGINEER DAVIS STATED THAT PECAN ROAD IS ONE OF THE DIVISIONS <br />FOR EVERY HALF MILE AND WOULD BE A COLLECTOR.ROAD, FOR WHICH IT IS <br />DESIRABLE TO HAVE 60' RIGHT-OF-WAY. <br />MR. MUSICK NOTED THAT THEY ARE NOT ARGUING ABOUT THE AMOUNT <br />OF RIGHT-OF-WAY NEEDED, BUT IF THE OWNER IS GIVING UP THE LAND, THEY <br />FEEL IT BEHOOVES THE BOARD TO ACCEPT IT AND LET THE PUBLIC PAY FOR <br />BUILDING THAT ROAD WHEN THE TIME COMES TO BUILD IT. HE CONTINUED THAT <br />NONE OF THE LOTS IN THE SUBDIVISION HAVE TO USE PECAN ROAD SINCE <br />THEY CAN ENTER IN OFF KINGS HIGHWAY. <br />COMMISSIONER WODTKE PERSONALLY FELT THAT WE ARE GOING TO <br />HAVE TO DEVISE A SYSTEM TO ADDRESS ALL ROADS SIMILAR TO PECAN ROAD <br />AND FELT THAT RIGHT NOW WE SHOULD SETTLE FOR THE RIGHT-OF-WAY. <br />MR: MUSICK FURTHER POINTED OUT THAT A MAN OWNING PROPERTY <br />FRONTING 1/4 MILE ON PECAN ROAD GOT A BUILDING PERMIT AND BUILT A HOME, <br />AND HE WAS NOT REQUIRED TO GIVE UP ANY OF HIS LAND OR POST ANY BOND <br />FOR BUILDING A ROAD,AND SOMEWHERE DOWN THE LINE, THE COUNTY WILL <br />HAVE TO BUY RIGHT-OF-WAY FROM HIM, MR.
