INDIAN RIVER COUNTY ORDINANCE NO. 76-11 <br />AN ORDINANCE AMENDING INDIAN RIVER COUNTY <br />J' 3 ORDINANCE 73-1, SECTION 25-1, AS AMENDED BY <br />INDIAN RIVER COUNTY ORDINANCE 74-21 ENTITLED <br />WALLS AND FENCES. <br />BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS <br />OF INDIAN RIVER COUNTY, FLORIDA, that Indian River County Ordinance <br />73-1, Section 25-1, as further amended by Indian River County <br />Ordinance 74-21, is hereby amended as follows: <br />WALLS AND FENCES <br />In all districts, except agricultural districts, fences <br />and walls shall be as follows: <br />FRONT YARD <br />Fences not exceeding 3' in height may be erected <br />in the front yard. Where the house or part of a <br />building is erected with a front yard greater <br />than is required by the Zoning Ordinance, then <br />the 3' maximum is extended to include all of the <br />area in front of the house or building. <br />SIDE YARD <br />Fences not exceeding 5' in height may be erected <br />in the required side yard, provided they do not <br />extend beyond the front of the house or building. <br />REAR YARD <br />Fences not exceeding 6' in height may be erected <br />in the required rear yard, provided that no fence <br />shall be erected in a utility easement. <br />Higher fences than listed above, and all barb wire fences <br />may be authorized by the Zoning Commission, who shall first determine <br />that they will be visually compatible in the area where they are to be <br />located. Fences and walls may not be constructed on or over dedicated <br />public drainage or utility easements or public rights-of-way except <br />in agricultural zoned areas and then only with the written consent <br />of the public authority holding the easement or right-of-way. <br />THIS ORDINANCE SHALL TAKE EFFECT ON June 14, 1976. <br />
